Hi All.
I started my iva in January 2008. Due to redundancy. Relationship break up. Lower income. I am still paying into an iva with no sign of a finish. I submitted my income and expenditure as requested. My pay has increased slightly due to the fact I was relocated to another depot and have a longer commute to work. Which costs me more money in fuel and wear and tear. I cover 300 miles per week so my employer made up the difference in fuel. In September last year I had to borrow £2000 off my mum to buy a car as my old one kept breaking down. I also glad my house repossessed last October so needed to find money for a deposit and rent. I also borrowed this from my mum. About a week ago I received an email stating that I had surplus money and that if I did not contact the office within 7 Days they would look to close my iva. I rang the office in my lunch break was on hold for 20 minutes before someone answered. The lady that I spoke to could not answer my questions because she didn't know my case. She tried to get someone to talk to me to no avail. She told me she would get someone to call me back. I asked her to ask if I could be called at home or in my lunch break. To date I am still waiting for a call back. I have sent several emails requesting a callback. NOTHING. After 9 years failing is surely not an option!!! I am still paying my car back and the money I borrowed to rent a house. I will have a shortfall on my house still waiting for my mortgage company to get in touch. I wish I had gone bankrupt. I would have been clear by now. Any advise please to a way forward would be greatly appreciated. Thanks

Can anyone offer any advise which way to go with this. My Iva company are no help at all. What are my options. Do I let them fail my Iva??

Hi there,

Sounds like you've had a rough time of it.

We do have experts from some iva companies that post on here regularly, so hopefully they will be along for you soon.

Who are you with and do you have a key contact or know who your specific IP is ?
Started IVA 27th Feb 2012 - Due to complete 27th Jan 2018 !!

Full & Final submitted and accepted 30th March 2015, paid 10th April 2015 - 3 yrs 1 month into IVA :)

Completion Certificate received- 30th April 2015!!

DFD I have been in contact with them all the time. Sorry to say all I'm getting is told they would be looking to close my Iva. After 9 years I am struggling. I certainly would not have entered into this had I known that 9 years later I would still have the worry.

Hi Chappie - I have looked back at some of your previous posts and I can see that you have tried to get DFD to help resolve this.

Yours is one of 2 cases at the moment on the board where DFD do not have a lot to be proud of.

Its amazing how they look to close the IVA on their terms but when you try and do the right thing you get nothing but obstacles and lack of ownership.

I would have thought that the IP would be monitoring your case like a hawk given the professional indemnity issues linked to the length of your case.

I can only suggest complain to DFD and the Insolvency Service, if there is a local debt charity speak to them to try and get advice and I hate to say this get in contact with another IP to see about the possibility of bankruptcy.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Do the old fashioned thing and send them a written letter by recorded delivery. INlcude all the ealrier e-mails that have not been replied to.

Bear in mind however that you have likely breached your IVA in not seeking permission to obtain credit (i.e. the loan from your mum) you may have to say this was a gift, rather than a loan.

Perhaps Mum can offer funds for an F&F to bring IVA to a close?

Thanks everyone. Laura was dealing with my case. Someone else is dealing with my case now. Endless nightmare. I dont really want to go bankrupt after all this time. #9785;

I appreciate what you say about bankruptcy but given how long this has been going on for I suggested it as an option that might allow the whole thing to end in a way that meets your needs.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Thanks yes I understand. Just very fed up and cant see and end or way forward. Fed up of struggling. May have to go bankrupt.

The way forward is for you to send them a written letter asking for a full explanation of what the hold up is and what they require from you to be able to close your case and mention that you are going to make a formal complaint to the gateway if a satisfactory reply is not received within 14 days.

Hi Laura. I have contacted you before. I spoke to some one last week after the email I received. I am still waiting for a call back. I leave my answering machine on when I am at work. I was told to contact your office within 7 days. I did straight away. Still waiting for an answer to what I need to do to sort things out and hopefully get closure.

Chappie from reading your posts about your situation before seing about closing off your iva your going to need to address the mortgage shortfall which from the repossession of your house.
Is your mortgage lender one of the creditors listed when your iva began in 2008.
For instance in my iva Nram were one of my original creditors in my iva so when I surrendered my house they were happy to include the mortgage shortfall.
If you don't sort this now you could close your iva but then the mortgage company could come after you for the shortfall and the iva will have been a waste of time.
Get the shortfall included if possible!
All new debts made since the start of the iva should be bound by the iva.

For the record my iva was with DFD and by and large they were sound
carefree wherever you may be......
