You need to formally invoke their complaints procedure and, then, if not happy, escalate the complaint to their regulatory body via the Government gateway at:

Yes I will do, I'm firstly going to e-mail my mortgae company and see if they have anything on the details about the Weightmans agreement. If they can send me the details I can send it to the complaints board and Aperture, mainly as proof that it exists and hopefully it can comfirm when it was put in place, in terms of the start of the IVA for possible legal matters.

There is a certain element of luck involved. I was transferred to GT, much to my disgust, having already rejected them when choosing my IP, and I made no secret of the fact with them !

However, the handler I was given was excellent and really helpful -- they got me through an incredibly sticky patch and to the successful conclusion of my arrangement.

This, however, was purely down to the actual case workers --- I doubt my IP ever saw the case, even his signature was rubber stamped !

I agree about the luck bit - I doubt that if I had remained with my previous company (which until 2014 had really good reviews) that my IVA would have been closed so quickly and with the completion certificate received.

Even our signature was an electronic copy.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Hi Lisa, thanks for your reply. The letter received states that a variation to the IVA has been rejected at the meeting of creditors. The assistant on the phone said we were in breach because of no 12 month extented payments and refusal to remortgage. I said to her that the 12 month extension, was never offered to us at all. It's all been pushed to us for a remortgage. Granted we don't really want to, but that is only mainly because we , being in an IVA, would get a ridiculously high interest rate from a lender that would give us one. The only other concern being that Weightmans having say taken their cut of the equity, the IVA, getting the £2,000 left. Where would that leave us?? The paperwork that the caller said would confirm the IVA has failed and more information has not arrived yet. I could send you copy of the last letter received if you like, maybe it would be easier as you would be able to make sense of the meeting etc.

Sheila, You will never get a remortgage, which is why the extension almost always applies instead.

It does sound on the face of it in your extracts above that you did refuse to remortgage.

I suspect you can retract that by stating it was erroneous and you meant to say you were not able to remortgage.

Personally I would challenge the variation - did you receive notice of it?

Go back in writing to the IP - agree to pay the 12 months and no need to terminate the IVA. Get it back on track.

Hi, no we didn't receive notice of a variation or meeting. Communication with them has been extremely poor. We had a request to fill in more forms for PPI with this new company or old company new name. We already did this with EIC. But this fact we would never get a re mortgage is the reason really that we are questioning why the push to try and get one?? We knew we wouldn't get one, it's not really a refusal. We don't understand why we were never given that option, we'd happily do that. I have the letter on paper I can photo copy it and send it to your company for your attention. I still haven't had a reply to the e-mail I sent at the weekend. They have my number too and no phone call. I have no credit in my phone left. Can't get a mobile on contract and don't have a land line. All this done so the IVA could get the most funds to it as requested but can be a pain when you don't hear from them and they spring things on you like this possible failure and more PPI requests.

The reason that they still want you to attempt to remortgage, knowing full well that AT THE MOMENT you will be refused is because that is what is written in the IVA .. this is what you agreed to do.

Now -- the reason it is written in the IVA is simply because the mortgage market is forever changing. In the early days of the IVA process it was possible to remortgage and the creditors are hedging their bets that, one day, this will be the case again.

Thanks Foggy but we don't want to be waiting for ,one day, to be able to remortgage for them. We want this ended and be free of it all asap. It's been 6 years now, as Lisa has said in the current times, we will never get a remortgage. If they had said to us, can you pay for another 12 months. We would have agreed. But again, left waiting and waiting. I have sent an e-mail asking if we can pay for another 12 months we will see what happens.

If you don't receive a reply quickly, print it off and send it via recorded delivery so there can be no argument it was never received.

I have had a reply from my mortgage lender, I think they are confused, they think the IVA is attached to the mortgage lol but I have corrected them and I have a number to try and find out if this debt of Weightmans is actually legally bound to the mortgage or any details of it whatsoever. If there isn't then I can finally move forward from that and look at releasing the equity if there is as much as they say is there. Haven't heard from Aperture at all again so I will write to them.

A land registry search should confirm whether or not Weightmans have a charge over the property.
