It's not just PPI at fault. For, as we keep being told, a "highly regulated profession" insolvency solutions are unbelievably open to mis-interpretation and manipulation (usually to the detriment of the debtor).

It is about time this was straightened out and tightened up from above. Even if the more rigid framework didn't go in our favour, at least we would all know, from the outset, where we stood and would be confident in the route we chose, based on that framework.

I've read on other sites that the Green vs Wright appeal is no longer being heard this week due to lack of judges. If this is the case what is likely to happen with my complaint with Cleardebt? Will they likely keep my PPI refund until the case is eventually heard or do they have to return the money seeing as current case law states that PPI refunds in those will completed IVAs and no deeds of assignments or clause regarding PPI is due to the debtor. I can see this dragging on for months!!

It has been delayed due to a lack of judges I believe but how that is going to affect you with Cleardebt I have no idea.

I agree I think it will drag on. Remember it was originally scheduled for January but got put back to May.

So the case can drag on for months or even years then. So where does this leave those people who have not been issued completion certificates pending the outcome of the case, and people such as myself who completed their IVAs year ago. Is it not time that the Insolvency Service stepped in and issued clear and succinct guidelines to IVA companies as to how to proceed in the interim

I'm afraid it leaves them in limbo.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

I think the point of this case is that the law is NOT clear, which is why it's being decided through the Courts and will set a precedent.

I've replied on the other post and I have asked Andy to put you two in touch with each other.

Both Frugal Friends and the email were disabled a long time ago due to lots of spam.

Unfortunately Lisa that is down to Admin. I have been on here since 2008 and the email was not running then but Frugal Friends was. I don't know why they stopped that one as it was easy to get in touch with others and if they didn't want to speak to you they did not have to accept you - a bit like Facebook.

Why not both contact Andy Davie and he will facilitate putting you in contact.

I agree with Lisa, an upgrade is due and then maybe the blogs can be resurrected? I loved reading the blogs, helped me tenfold when I was in my IVA. I did make a few suggestions once but to date they're not implemented or rejected.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I've emailed Andy about contact and also about the forum.

The problem with the blogs is that several people had theirs hacked with loads of spam plus others posting spam so the genuine posters just got lost.
