I took out a IVA in June 2010 and although I paid it off early cira June 2012 my credit rating is still very bad
I applied for a credit card in May 2016 and was turned down in 1 second on line !
I was vaguely aware of this 6yrs rule, will the IVA marker drop of my credit rating or do I have to write to different people
I had a recent credit report the score wasn’t bad . perhaps I should get one now post June 2016 ?
My mortgage company had a IVA marker (I never told them) would that drop of or should I tell them to remove it ??
Any help or links for further information greatly appreciated on how to tidy up my credit rating

I have the IVA completion certificate from June 2012

The IVA should have dropped off your credit record now and from your mortgage company.

As regards credit cards - I suggest you try the ones who do a soft search first which does not show on your credit record.

Do you have any defaults still showing?

This site was beacon of help back in those early days although I do remember being rather opinionated back then !
Ill request fresh credit rating report and see what it says
I assume there is never a ‘marker’ on a address
My partner had issues with credit (no bad history) but was immediately accepted today when she applied for a consolidated loan
I have no appetite to return to the 13 credit cards £100,000 max out debt and have happily lived without a credit card for the past 6yrs but it would be nice to have tidy up to date credit rating .
I had to get a car at 49.9% APR (no credit checks) so obviously would like to get something better next time I need a car

No, there is no marker on the address, just the person with the bad credit rating.

If you have defaults then you need to write to the data controllers at the creditors concerned enclosing a copy of your completion letter and ask them to remove the defaults back to the start of the IVA.

Something was put on the house maybe we couldn’t sell it without referral etc maybe a ‘interest noted’ I wonder if that came off and its help my partner ? Anyway will look into it

That should have been taken off when you finished the IVA.

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

you can do a title charge at land registry online for £3 I think on your address, it will show who has charges over the property at the end of the report, it should have been removed but a good way to check.

I have spent a year trying to clean up my file since discharge and I have to say the amount of mistakes is monumental. I have literally today sent all the stuff off to the financial ombudsman and ICO about companies refusing to correct the data and incorrectly reporting defaults after the date of the IVA up to the settlement date, driving me crazy !

The agencies love to say it's not their job to correct it but then when you get a £2 report from the 3 agencies you see 2 of them have it right but one doesn't which would suggest it is actually the CRA's that are not handling the data correctly. So I have made complaints against the CRA's and the lenders and the ombudsman can find out exactly who is breaching the DPA !! grrrr

Very frustrating that longslog101. In my experience it's normally much more straight forward. Is it the defaults you are struggling to have removed?

wrong dates for defaults (some using discharge date)
Some still showing as a balance outstanding
some which I had cleaned up suddenly appearing with balances 3 months later
some showing the account still defaulting.
Some the the collecting firms ( Arrow global for example) with all sorts of weird and wonderful data
SERCO with wrong dates....

a minefield, I;ve got so hacked off with I have now sent the whole file to the ICO and ombudsman and cc's the respective creditors asking them to sort it out because they keep blaming each other !!

That said Equifax data seems to be a lot more accurate than Experian's which seems to be a total mess !!

I am of course having my own private little fight when them as I still cant find any legislations that says they can report completed IVA as public records on the report, CCJ's yes bit it just seems to be an industry norm to do it with completed IVA's, but nothing actually supports it in wiritng that I can find. The ICO were useless and just said oh, its just what happens.

I'm arguing hard that the DPA & handling of sensitive data acts and the lack of a a requirement to share that bit of data is not a necessity to achieve their obligations as financial history is proof enough and they are not carrying out the balancing act etc, they are all being difficult on that one so I think I will take all 3 of them to small claims court to get a judge to make them show under what legislation/SI they are allowed to report said confidential data as public information (which isn't in the public domain) and which I have not given them consent to shar. We give consent for financial information yes, as the agreements we enter into with creditors allow it, But I don't recall or have anything that says I allow them to share my private completed IVA data.... the battle continues...the longslog lol

It's really unusual to see it proving to be so difficult. Is your IVA over 6 years old since commencement?
