My husband and I have been in an IVA for nearly three years and one of his debtors, HSBC didn't vote at the meeting and as far as I am aware has not claimed any of the dividends so far.

After hearing nothing from them since 2006, they rang my husband up and was demanding payment (and they were very rude!). He explained that we were in an IVA and tried to give them Accuma's details but they didn't want to know.

What do you think is our best course of action? Do we ignore them or write to them or mention this to Accuma? [:)]

HSBC again!! They are my major creditor 40% and the creditors meeting is on 5th May; I hope they don't make life difficult. They seem to be very troublesome from what I've read on here.

they are bound by IVA no matter what.

I'd mention it to Accuma, after all HSBC shouldn't be doing this at all.

If they phone again I'd either ignore it or just politely point out about your IVA and that it is illegal for them to contact you asking for payment.

If they persist, then you will be contacting the courts to complain about the harrassment.

It worked for one of our posters last week!

I assume that this is a technical hitch, where perhaps the left hand is not talking to the right - but there is no need for rudeness from anyone. I would ignore this matter and move on.

It won't hurt you writing to them (quoting your account number) informing them that you are in an IVA with Accuma (copy Accuma in with your letter) and tell them (a) to stop being rude and (b) stop harrasing you as it is illegal for them to communicate with you in this way.
