My wife has been approached by lloyds tsb to pay an amount that is already being paid by my IVA can they do this and is it legal?
she was a co-signee for one of the debts but lloyds have accepted the amount in my IVA.

Hi,

If the debt is in joint names, or your wife was a guarantor, then even though it is included in the IVA, she will be chased for the full amount as you are both jointly and severally liable for it.

If she cannot afford to pay the full amount each month, then she needs to try and negotiate lower payments with them.

Your IP should have spotted this and advised you to get your wife to discuss this with the bank prior to your IVA being proposed.

you need to contact your ip all your circumstances and wifes regarding debts should have been assessed,before your iva was proposed.

Very poor show from an IP who cant possibly have missed something like this.

Things like this happening is often what puts people off trusting IP's in the 1st place.

Why cant they all be like you Mel?!?[;)]
Discharged today the 8th feb 2012. View is much brighter now.
