Does my IVA stop me being an executor for an estate?
I am currently in the middle of an IVA and understand the rules about windfalls, I would not benefit anyway. However a good friend of mine is making a will and has asked me if I'd be an executor. I don't remotely expect the worst to happen during the remainder of my IVA but is there anything legal that would stop me acting as executor due to my IVA?. I would hate to have to ask him to redraft his will at some point if I am not eligible.
Hi Jaytee
No, there is nothing preventing you from acting as an executor of a will. The duty of the executor is to carry out the instructions of the will and assuming you don't benefit then there is no issue surrounding your IVA.
