Hi,
My husband and i have 2 years to run on our IVA, but had to have payments reduced last year as i lost my maintenance which meant we had a lower income, will the fact we reduced our payment extend our IVA in order to make up, are they right to include maintenance as income in the first place?

Second part is it possible to live we are so skint all the time, and have now had a letter saying that we have to pay half of the bonus my husband got last year £500 asap or they make us bankrupt as we hadn't told them this was not intentional our car had broke and used it to replace that so we could get to work i actually never even gave a though about the IVA obviously i have emailed them this explaining I am awaiting a reply, they have also said they want to put up are payments as my husband did the annual review without checking with as i was away with work, and he didn't put half the stuff on!! I have asked them to allow me to re-do it i hope they do iam sick of strugling but hub won't go bankrupt cos of pride and it could affect both of our jobs!!

Hi,

I am sorry to hear about all your problems.

When you initially did the IVA, did you know that you were going to be losing the maintenance? If so, this should have been taken into account by your IP when drawing up the payments.

You should have to pay 50% of the bonus across as per your proposal, but if you have had problems with things breaking down, then this could be taken into account. It is unlikely that they will make you bankrupt unless it specifically states this in your proposal. It is in no ones best interests to do this now.

You do need to sort out a new I&E with them. Have you emailed your IP direct or just one of the office staff?

I've answered you on your other thread, but if I were your IP I would certainly allow the review to be redone, and if I thought you were struggling to meet the payments then I would see if they could be reduced - if necessary by calling a creditors meeting. The review would take into account your current levels of expenditure - and would query items which had increased significantly.
