As Jan says, this will really depend on the different creditors you have got. Some may be inclined to take court action fairly quickly while others will never go down this route and simply employ debt collecting agents. Nevertheless, it is always a good idea to take action to resolve your debt problem as soon as possible. How much do you owe?
It is down to the creditor to decide but they will usually attempt to contact you by phone or letter, or pass you to a collections company before taking court action and this takes many months. It costs them money to take court action so many creditors see it as a last resort but again that's generally how it works, a creditor may decide to start court action much earlier depending on the circumstances.
I missed four months payments before mine was agreed and had no threat of court action at all.

These days creditors would rather hound and harrass you on the phone and by letter, rather than spending more of their money in pursuing you via the Courts. If you are a homeowner, there is probably more risk of legal action, as creditors may believe you have equity in your home which you will want to protect.
