I made a f&f settlement for my partner in January 2011 two years early. Before the F&F was made DFD were aware that my partner may be eligible to a refund on some ppi under this refund policy if you dont pay. However Firstplus were refusing to process the claim due to ongoing legal action for misselling of the PPI. We have now found out today that since the f&f settlement Firstplus have paid the ppi refund to DFD. DFD do not know if my partner will be eligible to have this repaid to him. Any advice please

Hi Kaz, I really don't know the answer to this except I completed a F & F last October and in February when my IP was getting ready to issue completion certificate, I had to confirm that in the meantime I had received no inheritances or windfalls. My understanding is therefore your IVA is not complete until the completion cert is issued
F & F Accepted 19th Oct 2010

there is another similar thread to this one - my understanding as soon as the PPI refund is known(not just paid), its included into the iVA

The IVA isn't complete until you get that certificate so if you receive a windfall beforehand it should be paid across to the IVA, I assume the same would apply to a PPI refund as ginger says.

Thanks for the replies. Not what I was wanting to hear. DFD were aware of the PPI but did not included the figures in the creditors meeting for the F&F. Also we were told by F/Plus that the payment would not be made until the outcome of the impending case for the mis-selling of the PPI, that will probably take another year so then to find out that its now been paid to DFD has completely baffled us.

How long does a completion certificate take - its been 6 weeks now and we have heard nothing.

It does depend upon how long it takes them to close your case. I'm sure that Declan will be along later with some advice. You could try emailing him via his details found under the 'Ask a Question' link on the left hand side of the page.
