Will closing be backdated to last payment ?

Hi,

My IVA is with Grant Thornton and I finished my last payment last January, however have never had and a closing. I have tried to contact them three times from the 1st anniverery on the 21st Jan 2012 and they're to busy to call me back. I am still waiting. Does this mean the my closing will be of this year or is it back dated to the last payment?

Hi Gaving and welcome to the forum

IPs are still in a dilemma as to whether they should be closing cases due to a recent change in VAT legislation which is affecting all case progression. It is tedious, but there is nothing we can do about it until clear guidance is provided by our regulatory bodies. You should still get this directly from your own IP, who ought to be keeping you in the picture.

Why can IPs not operate under the old procedures until new guidance is issued?
Completion Certificate received September 2012.

Hi
I paid my last payment in December and have just checked the insolvency register and I am still on it! Am upset to say the least. when does this come off? Do I have to wait until the completion certificate arrives? Which could take all year according to 'new VAT rules' and therefore practitioners not closing cases.

Frankly I find this unacceptable as I entered into a court agreement for 60 months and I have upheld my part of the agreement. My IVA firm has been paid to do the work and in my eyes they should complete the work they have been paid for. If I had not completed my payments then my IVA would have failed!!!

Sorry for rant but have held my breath it feels like for 5 long years and now when it should be all over I feel as if the IVA solution still has me by the balls with still no end in sight.

Hi Barbarella,

until the completion cert is issued you will indeed remain on the insolvency register. Your IP will send a copy to the Credit Ref Agencies at teh same time they send you a copy.

Not what you want to hear i know.... :(

Was this VAT legislation change a problem as far back as January 2011??

I thought it was just a recent thing, in which case how on earth has your IVA not been completed if its more than 1 year since your final payment.

This whole completion problem is getting beyond a joke, after 5 hard years we deserve better. [:(!][:(!][:(!][:(!][:(!][:(!][:(!][:(!][:(!]

IVA COMPLETED ON THE 17th MARCH, FINAL I&E COMPLETED 26th APRIL, COMPLETION CERTIFICATE ARRIVED 2nd AUGUST

All of the issues you guys are raising have been raised with our regulators, HMRC and the lawyers involved in advising both. Rest assured that IPs are just as frustrated as you guys about this issue, which we became aware of around 6 months ago and is still yet to be determined.
