My IVA advisor, in my opinion has been very unlawful. I will try to explain best I can. He advised us through our IVA. He then got a friend of his from another company, to sort out a directors petition to wind up our company. The company owed about 8k, but had no assets. The friend took £900 first payment, but then in my opinion, got cold feet and said she could no longer continue. The £900 was transfered back to our IVA advisor, who then asked for a further £1800, to complete the petition.So we were £2700 outstanding, this over 10 months ago.The company is still reg with companies house and we have not had anything from the courts.I have called their bluff via emails to both parties saying my accountant wants receipts, also contact their works accounts and I will get an independant company to chase up with the courts, to what has happened to our money. All of a sudden he tells me the courts have responded to him and the money will be returned on Monday, back into our account !! I think they knew that the original debt would be written off and took the chance to make up this petition. I hope this explains the best I can and make people aware of the dangers out there, from this type of people. Can one of the experts please advise if I should take this further ??

I don't know enough about regulations surrounding IPs to comment, but if you feel there was something wrong with how your case was handled you can take advantage of the companies internal complaints procedures. If you are not satisfied with the responses you get, then you could go to their regulators with a complaint.
