Court are seeking documentary evidence that I have attempted to take out a mortgage

I am currently in an IVA and getting divorced, my husband asked that I buy him out of the mortgage but clearly cannot. It is now going to court and despite taking advise from banks and an IFA re taking on the mortgage solely, no one has given me any written confirmation that I cannot take out a new mortgage in an IVA. The court are asking for documentary evidence that I have attempted to seek a mortgage. Is there anyone who can help me get documentary evidence of the fact I cant take out a mortgage within an IVA? My hearing is on MOnday 17th
IVA approved 18th Sept 2010!!

You need to attempt to obtain a mortgage to get written confirmation either way, otherwise you cannot be certain that you cannot.

If you approach 2 lenders and get rejected by both based on your current circumstances then you should be able to get this in writing and provide it to court.
