Hi Busybee,
So sorry to hear you are having so many probs regarding your cc,I was with GT too, paying into my IVA for 2 years before having an accident & because of that having to leave my job, I stopped paying my IVA in feb 2012 & didn't get my closure cert from them until may 6th there this year ( i wanted to go BR & due to all the stress from GT my mum paid a solicitor to help with my BR paperwork & go to court for me)they were unable to proceed with anything until GT issued my termination cert, GT told me in oct 2012 that my creditors had agreed to terminate my IVA SO WHAT ON EARTH TOOK GT 7 MONTHS TO ISSUE THE CERT?I've found them to be an absolute nightmare & on second thoughts i wish i had used another firm but it's done now, Maybe karol who posts for GT on here could give you some answers, i haven't seen her posting for a while.Try & keep calm,i'm sure you will get sorted soon.x[:)]

I was thinking more about the PPI being given back to the creditors and I suppose that at the moment if there is any to be distributed that its probably in a different "section" of money for the creditors. There must be a lot of internal transfers between different departments.

Another day here with no post (am waiting on a cheque im meant to get by the end of June as well) - maybe tomorrow. Think it will all feel a bit of an anticlimax if the CC ever does come.
Paid F&F in July 2012 and received CC in July 2013 :-)

A couple of points which may provide some clarity:-

1 PPI reclaim money can only be deemed to be an asset of the IVA, if the proposal documents specifically refer to this or they include all of your assets, less those excluded. Some IPs are presently seeking to vary the terms of clients IVAs to make these monies be included retrospectively.

2 Investigating and chasing PPI claims should not delay the closure of a case. We have clear regulatory guidance confirming this and advising on methods to bring cases to conclusion satisfactorily.

3 Due to the magnum of caseload, some firms will be taking longer than others to deal with this issue. The regulators are aware of this, but may find themselves unable to intervene in any great degree.

4 All IP firms are required to publicise details of their regulators and their complaints procedures on their websites, and in all initial terms of engagement with their clients.

Melanie GT do not take 1) as thier opinion, They say we should of known about it and if we didnt its our fault (The fact They didnt even know about it means nothing)and will fail our IVA unless we pay any PPI to them, thier legal opinion is whether or not it was included in the IVA they think it should have so are treating it as such.

Oh yeah and they failed with thier 2nd tier complaints procedure yesterday by failing to reply in time and thats after failing first tier (which they tried to cover up by back dating letters unfortunately the postal service didnt back date thier time stamps)
I regret the day i was forced to join GT with a passion

Thanks Melanie and Viperboyz. Ppi isn't mentioned at all in my terms and conditions and I had never even thought about it until now. As our creditors have agreed and we have paid a settlement figure 10 months ago, can Grant Thornton fail my iva at this point if I do not agree to them claiming the ppi and what would happen then?

Hi Busybee, no they cannot fail your IVA however it could hold things up if your proposal is worded in a way that PPI claims could be persued (it should hold things up but it seems to be doing with some companies). Clarify with your IP as to the wording of your proposal and where it states that PPI can be claimed retrospectively.

Viperboyz - sorry to read what a frustrating time you're having - hopefully at some point this will all be a bad memory behind you but persevere for the meantime. I wonder if anyone from GT will come on to pick this up from here seeing as the complaints procedure is not being followed.

Well another 6 months on, have sent numerous emails to our ip who does not reply and answer our questions. Have always been polite in any form of contact with GT and our IP but I'm getting really peeved at them now. I am not really a complaining sort of person but think I am going to have to make an exception :(. Really really disappointed with them.

You have been patient and maybe your time is coming up. We have seen some positive moves from GT today on the forum so maybe a little complaint using their internal procedures may speed things along. It is a shame the certificate issue has taken the gloss of your achievement and also the good work GT did up to the date of the last payment.
