After completing my IVA my niece who works for a claims management company asked me if I wanted her to check whether I had been misold PPI. I said I had no objections but didn't think it would be fruitful as I had, as part of my IVA paid six hundred pounds to my IP to investigate PPI but they hadn't recovered any money. My niece said I had nothing to lose and began her investigations. To my amazement I had been misold PPI and was made an offer of £4,567. However RBS sent the money to my IP. I have never been made aware of any post IVA arrangement and of course at the time of taking out the IVA I didn't know that I had been misold this. Therefore my questions are - can the IP retain this money even though all my debts with creditors are now closed. And if this is the case can I ask them to refund the £600 they charged me to investigate any outstanding PPI? Finally as this claim was managed by a completely independent management company on my behalf will the company be eligible to claim their fee from the IP?

I think they can retain the monies as they were an asset of your estate whilst you were in the IVA.
Did you actually pay the IVA company £600 to investigate PPI or was it taken out of the contributions that you made ?
