Last payment August 2012 to GT. No certificate. Am I liable for any PPI claim to go to my IP ?

Hi, I entered into IVA with BE then was transferred to GT, I made my last payment in August 2012 and was told my CC would take around 3 months. 13 months on & no CC, I have received a letter of of engagement & letters of authority to sign from a PPI company in Carlisle asking me to sign and return in order to claim PPI against my IVA. There is no mention in my IVA Contract of PPI. As my final payment was 13 months ago am I liable for any PPI claim to go to my IP via my (finished but no CC)IVA?

Ppi will go to creditors. Even if you had your certificate of completion many creditors would offset any payout against debt written off. Has the ppi firm been given your details from your iva firm?

It really does depend upon the terms of your agreement. Are GT saying that they believe the PPI refund is an asset of the IVA? Not all agreements provide for this, so best to check the terms out to be sure. It is a shame that this issue is holding up your closure. When were you asked to sign the PPI forms?

The forms arrived last Thursday... passed to this company in Carlisle from GT

Melanie GT's stance on all PPI is they think all PPI due to the IVA even in defined assets style IVA's where it wasnt included because we should of delcared it even though we didnt know about it,ironically as professionals they also didnt know about it but that dosent matter.
As daft as it sounds this is thier opinion not legally established stance another part of thier gravy train policys.
Time to end of IVA 0 days

I actually think that they are following their own legal advice, and that this is what they have been advised. Our regulatory guidance states that IPs should seek and follow legal advice, so I guess until this is challenged no-one will know who is right. Very frustrating for everyone - including insolvency professionals.
