It appears that TSB have not included one of my debts in my IVA and it is showing as a default

Sorry for asking another question but i've looked more closely into my last. I had 75% of my debt in my IVA with lloyds TSB. They now it appears haven't included one of the debts in the IVA, no-one told me about this though. No-one at any stage made me aware that my IVA wouldn't be a full consolidation of my debt. So now I have this outstanding sum, that is still showing as a default on my credit report. I have sent numerous letters, phone calls, emails to Lloyds TSB and freeman jones to no avail. Now i've applied for a finical check to allow me to rent a property, and this default which i assumed was an error, is obviously going to kill my chances now. What can i do? Is there an ombudsman i can make a complaint to? Lloyds TSB were the main company included in my IVA, they put the 4 other accounts into the IVA, and they declined my offer of upping the full and final settlement to 40p to the £1, and they accepted 36p to the £1. Am i liable to pay this back now, even though they should have included it into the IVA? what do i do? I am fuming, and obviously feel i have been treated extremely unfairly... noose around my neck ready to kick away the stool! This should have been done with months ago.

This debt is bound by the terms of the IVA as they had ample time to submit a claim and were made aware of the IVA. Contact Sarah from FJ who posts here as she has helped numerous FJ clients. Her details are in the ask an expert section.

Hi Sarah,

Just to let you know, i had a call from Lloyds TSB this morning, and they received my complaint from the financial ombudsman, and they have rectified their error. They said it will take 60 days to amend my credit file, and they will backdate the default to the start of my IVA, and they have compensated me for the stress and expense this error caused.
I will check my credit report in 60 days to make sure that they have intact changed it, but from my understanding they have resolved the issue now.
