Told our IVA failed November 2014. Heard nothing since. How soon can we start another IVA ?

Hi we were told at the end of nov 2014 via an answer phone message that our iva had failed in year 4 after us not disclosing extra earnings we then admitted to these extra earning vai a phone call and asked if we could pay back what we had earned even if it meant extending the iva the answer was a straight no we were told that the choice had been made to fail it and that we would hear from them in a few weeks time. Well we are now in feb apart form thos one answer phone message and the one phone we have made we have heared nothing at all not even a letter telling us that it has failed ......what is the usual time it takes when an iva has faied to hear anything from the comapny as we have heared nothing and now we are a as now we are earni g a little bit more we want to re start another iva as except for this small hiccup the iva was going fantastic and we had almost reached the end so wanted to ask 2 things when do you think we will hear any more??? and how soon can we then apply for another iva ???(The iva company that failed us said there was no reason for us not having another iva with them ) found this a touch bitter sweet when we offered to repay everything extra we had earned we come so close to the end but looks like we have to se start all over once again thanks everyone

I am surprised there is no way back from the breach.

If a debtor is in breach of an agreement, the terms and conditions usually state the supervisor will state how the breach can be remedied if that is possible.

In the case of undisclosed extra earnings the remedy to me seems quite simple in that you can pay it back.

Questions:

What was the nature of the extra earnings? (Overtime? better job? cash-in-hand work?)

How much were these extra earnings?

Who is the IVA company?

We might be able to offer some tailored advice based on the above.
One pay-cheque away from oblivion!

Seems very unfair and woukd have thought you ahpuld have been notified in writing. Have you spojen to your IP or a caseworker ? If it were me I would insist a conversation with your IP direct ... don't be fobbed off.

This does seem harsh and in breach of protocol. Are you still on the IVA register?
