She received a letter for her annual review and complied. She informed them she had a husband. They mentioned her husband in the letter and said it was all OK and she didn't owe anything further..
Now wrote to say that does she get maintenance from me. She rang them and they said they had made a mistake and even though they knew she had a husband they FORGOT to include me. They are looking for my bank statements now and proof we share the bills..
What penalties could come from this?? Will she owe loads of money ?? It was their fault.
First of all you need to dig out the paperwork and see what is says on there. Who is the IP? Was this passed on to another company as I can't see anything about an IP on there.

sounds like an oversight at the time and now they are covering all bases.
When someone is in an IVA some IPs like to know what the household income is to work out the split of the expenditure.
You do not have to provide this information but if you don't they can only assume the total household expenditure is split 50:50, which would only affect your wife's payments if she pays more than 50%.
Cheers for the replies.. I'm not sure of the IP but in a letter they clearly state about her husband and that she does not owe any additional.. Then they sent her a threatening letter saying she's not complying when she is FULLY.. She is really concerned now that she will owe a lot of money we do not have.. We pay half of the bills each but I put my half in to her account so it all comes out of hers... How can I prove we pay half ??
It will tell you on the register who it is and if they are speaking to her like this I would make a complaint.

You could show them your I&E if you're in an iva too as this will show your allowances for half of the bills I guess.
Case workers for iva companies are also human and it may have been an oversight or did they mean that the previous year that had been reviewed was ok but that going forward, you should be included.
For her new I & E I assume her paperwork indicated her payment should significantly increase as you're now sharing the bills? Surely this would also have indicated that things had changed? Did she pay the increased amount from then?
I would write back and ask exactly what it is she is not cooperating with and mention that you will consider making a complaint about the way you are being treated. If only one of you is in an IVA you do not have to prove the income of the non debtor.
Soo I maybe wrote this when emotions a bit high.. So they admitted it was their oversight.. She is 4 years I to iva and we got married 2 years ago. She told them but they didn't take in to consideration.
Main thing is are they going to look back paid or as long as we can prove she has paid 50% of the bills will everything stay the same??
She would ask them but they are not overly helpful ..
Unfortunate - this company usually come across as hard but fair.
Dignity and respect seem to be something that is lacking from some companies at the moment when staff are dealing with clients (and I'm not just singling out this one).
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
To be fair (and I don't offer this as an excuse), this is one case handler and doesn't always reflect the attitude of the firm itself --- which is why you should try to speak to the IP directly -- as I am sure they would not want their firm sullied by an under trained case worker on a bad day.

My emotions would be high if I'd been spoken to the way you were. I would still complain about this.
Your IP needs to establish what effect, if any, the marriage had to the income. If you were already in partnership before and the finances for both of you haven't changed then I don't see that the I&E would change just because you then got married.
