Having problems with paying IVA, I don't want to tell them I have moved.

HI I HAVE AN ONGOING IVA. I HAVE MOVED AND MY REVIEW IS UP SOON. I AM HAVING PROBLEMS WITH MY WIFE AT THE MOMENT AND DON'T KNOW WHAT TO DO. I DONT WANT TO TELL THEM ABOUT MY NEW ADDRESS. I PAY THEM PRETTY MUCH ALL MY SURPLUS INCOME AND THIS XMAS WE STRUGGLED COULDN'T EVEN GET KIDS ANY PRESENTS JUST BOUGHT LOADS OF STUFF FROM POUNDLAND. IT WILL SAVE ABOUT 90 EVERY MONTH BY NOT TELLING THEM ABOUT ME MOVED HOUSE. DO THEY CHECK YOUR HOUSE RENT SITUATION AND BEING IN COUNCIL PROPERTY THIS TIME.

Hi and welcome to the forum.

Little tip, try not to type all UPPERCASE ;)

You must tell your Iva company if you've moved. If the rent is different then a review may be required.

Moving house without telling them is very unwise and contrary to the spirit of an Iva.

If you're struggling to pay then something is wrong. In an Iva you should be able to manage comfortably. That's the whole point of declaring income and expenditure.

I'd call them and tell them everything. Then they can help. Nobody wants an Iva to fail.

Seek a full review of your income and expenditure. Although life in an iva is not designed to be easy it shouldn't be leaving you with nothing

A change in circumstance needs to be declared - your house move needs to.be declared as this may result in changes to monthly payments - potentionally in your favour.

Good advice above. Failing to tell them of the change of address and rent reduction can cause grief on two fronts: First, rather than being against the spirit of the IVA, it is actually contrary to the agreed terms of the IVA, so you will have broken your contract, breached the IVA and it could be failed. Secondly, hiding funds from the creditors is also against the terms of the IVA which could lead to it's failure and, in extreme circumstances is fraud.

If you are struggling do speak to your IP and work out why -- either your I&E is adrift somewhere or you are not budgeting very well ---- an IVA is no bed of roses, but it shouldn't be a living hell either !
