I successfully completed my IVA Dec 2011, now I have a rather large PPI claim against RBS upheld only to be told the complaint has been passed on to the insolvency dept and they are waiting on the IVA practitioner who will not reply to me. I have managed the claim myself as I am reluctant to allow so called claim management firms there hefty slice. Can anyone explain to me what's happening?? Thank you.
The PPI is deemed to be an asset of your IVA (even though it has completed) as it existed (albeit unknown) during the IVA. Your former UIP will decide if it is worth digging out the old files to distribute this between your former creditors. Oftentimes this proves to be uneconomical and they will return the PPI to you --- but it is in the hands of your former IP.

Yes I have read of other cases where compensation is regarded as an asset and understood the arguments for and against, what really gripes on me is the fact that both Debt Free Direct ( the IP) and BoS do not have the courtesy to inform me of there decisions even to the point of ignoring my correspondence!!
