Completed IVA and had certificate. Had some monies refunded to me from an overcharge that the bank did years ago now the IVA company are saying they can keep this as it’s part of PPI but it’s nothing to do with PPI. I was lied to about the PPI saga and forced to sign this and now even years after they are dictating. Where can I refer this to have it investigated and how do I have this PPI sage investigated as well.

I suspect that overcharging would be treated the same as PPI but hopefully one of the other experts can help in more detail.

PPI was never specifically mentioned, neither are refunded charges. However, they are both considered after acquired assets and are grabbed under those clauses, whether you signed an assignment or not.
Although most IPs are not under the remit of the FCA, their firms might be, so linking that to the fact that the PPI saga was under the FCA remit, maybe the Financial Ombudsman would look into it --- but I doubt it.

If the complaint is about the IP firm then it would have to be addressed to them and their regulators. If it's about the PPI claims company then it's the Ministry of Justice (MOJ).

I agree that it is probably classed the same as PPI and as such I personally think it is due to your creditors.

Thank you all for the response and advice. I believe the Iva company is treating it as PPI and having been out of this saga for 15 months I can’t be bothered to chase it or waste my time anymore they can have it.

I have rebuilt my life and am living it now without the IVA and am just glad it’s over.
