I received a letter from HMRC at the end of July saying they would be seeking to recover £1200 from me as I had been overpaid child credit. I didn't know anything about this and after asking the wife about it I found out that my wife (who was my partner then in 2010) had put my name on joint claim for her son who had started college and not told me. He didn't last too long there and he got a part time job with Wetherspoons in Walsall and then Birmingham, where he works full time now. I`ve sent all correspondence to Aperture and was told they where on the case and would try their best to resolve the issue I didn't hear anything from them after that email so I took them at their word they were handling it I also didn`t hear anything from works & pensions. I`ve just got my wage slip for Oct and I've got a court order for £284.50 which I knew nothing about, I've not had a letter off Aperture or custom & revenues telling me it was coming into effect. All I've found out about it is opening my pay slip at 2 am this morning at work. I`m now terrified I'm gonna not be able to keep my self and the wife in our council house and pay the bills. I`ve worked all my life especially all the way through covid (I work for a security company). My original Iva was with Grant Thornton then Jarvis & now Aperture, I`m approximately 8 months away from finishing the Iva. Every time I try to call Aperture all I get is a call centre either in India or South Africa I never seem to get to speak with my Insolvency Practitioner.
Have you tried to speak to them or are you using old Aperture numbers ? Who is your IP ?
Unfortunately DM use an offshore administration company, based in Mauritius --- they do not appear to know what an IVA is, let alone be able to sort out issues, being, basically, a pumped up call centre. You need to contact the IP directly.
Edit: Apologies -- they use a call centre in South Africa.

Can I also suggest that you remove your email address from your forum name. This is to stop you from getting lots of spam.

yes my mistake it is Debt movement who handle my IVA and i was refused permission to talk to the IP today "They don`t take calls" i was told... I`ve been sent an email telling me they told DWP to refund the money ASAP as they where in breach of my IVA.... Yeah don`t think that will happen... i`m wondering if i should make a formal complaint to them and then escalate to financial ombudsman?
A formal complaint could be a way forward. If and when escalated, the regulatory body will not intervene directly but can levy (often substantial) fines .... the threat of which often focuses an IP's mind.

Obviously in your situation you want this IVA to complete. I suggest you tell Jarvis that you feel you were badly treated by Aperture who said they would resolve this debt. Tell Jarvis you want them to either get the debt included in your IVA (and reduced to half - HMRC will usually do this with tax credit s overpayments where the couple has split up) OR you want them to agree to your IVA being completed "on the basis of the funds paid to date". That has to be approved by creditors but will just complete the IVA, leaving you to deal with the tax credits overpayment.
But the worst case isn't that you lose your house. It is a secure tenancy. If your IVA fails, you go bankrupt and that will clear the tax credit debt as well.
Hi there, I can assure you that Debt Movement will be able to assist you with your query regarding the court order the HMRC have put in place. We are sorry to hear that you did not receive any assistance from Aperture during your time with them. As you may be aware, Aperture is no longer an existing company as all their active case were acquired by Jarvis Insolvency, who have now rebranded to Debt Movement. Although we can not discuss the processes another company chose to follow, we can try our best to assist you with this query going forward.
Please may you take a clear picture of the letter you received from the HMRC, as well as the court order and email our Client Services team at clientservices@debtmovement.co.uk . Should you also prefer to speak to an agent, our number is 0333 987 0000.
Furthermore, Debt Movement does not have an offshore administration company in Mauritius.
Hi Kelly. It was widely reported that in August 2020 that Vanguard cases were being administered by Ebenegate --- is this no longer the case post transformation to DMUK ?
Edit: Apologies : The call centre is in South Africa -- Affinity Solutions

It's worth noting that Vanguard and Debt Movement aren't linked in any way.
Vanguard IVAs are serviced by Ebenegate, who have close links with Creditfix. Ebenegate are based in Mauritius.
Debt Movement, formerly Jarvis, acquired Aperture in September 2020 and many of the original Aperture staff were grandfathered into Jarvis/DM. Well, at least they were until being made redundant this month in a cost saving excercise - bye bye UK based DM staff. DM outsource the supervision of their cases to a company in South Africa called Affinity Solutions, which is concidentally owned by the CFO of DM.
Hi! I used to work for one of the UK's biggest Insolvency Practitioners - I don't work for an IP anymore but still have an extensive knowledge of the IVA industry. How can I help?

Thank you WallE --- I am, I admit, losing the plot with all these changes and rebrandings, further confused by one poster, who DMUK responded to, actually being administered by Ebenegate. However, it seems that the DMUK representative was just using a 'scattergun approach'.

Perhaps slightly telling that they expect anyone with a problem to be one of their clients
