Hi my partner is considering an IVA owing just over £20,000 to 4 different lenders. She has one CCJ against her name and one threat of a CCJ against her at the moment. My question is that once a CCJ has been issued for the debt can that debt be included in an IVA proposal or would they have to be seperate has they have already been dealt with by a court.
Thanks

Hi
An IVA will overide any CCJ,the creditors involved with the CCJ would stand alongside other creditors and receive the same dividend.
