Lloyds TSB as a creditor

My IVA was approved over 2 months ago, but I am getting 2-3 phone calls a day every day from LLoyds TSB. My OH is being hassled by his creditors too.

I have told them I am in an IVA, but it is a call centre in India who deal with collections and I honestly don't think they

a) understand me and
b) Know what an IVA is.

They say they will update their records and not contact me again, only to do so a few hours later. I was looking forward to the security of an IVA but things are far worse now..when we were paying our creditors we didn't get any hassle..and now...it's just awful.

We went out last Saturday for a few hours and were rang about 5 times by one of the OH's creditors - and they got really nasty and threatening..saying Capital One sold the debt on to them and that Capital One had no right to vote on the IVA, that they didn't recognise it...urgh!

I am so annoyed with Lloyds for farming out collections to a foreign call centre with operatives who can barely speak and understand English. I am so fed up with hassling phone calls and letters which we never had before the IVA started.

I rang the LLoyds help line but as I am no longer an account holder (closed account as per instructions on IVA document) they can't help me.

This is really getting me down now, I have turned the phone off but I still have answer phone messages from them and I am terrified they are going to turn up at my home. My mum helps out with the kids a lot and I don't want her to know of our money problems and worry (she had a small heart attack a year ago brought on by stress).

It isn't like me to feel so upset and defeated but I do. I just can't understand why we are still being harassed like this. Is this normal?

I am constantly looking over my shoulder to see if the debt collectors are going to turn up. What should I do if they do turn up? Let them in?

I know I am rambling, but I just feel pretty much at my wits end at the moment.

First of all angelrainbow, if debt collectors do turn up, and I'm pretty sure they won't, DO NOT let them in. It does take some time for the information to be passed to the relevant department. Just speak to your IP and let them know what hassle you are getting. They will sort it out for you and you are protected in an IVA. Sorry you're upset, it is horrible, but they will eventually stop.

There is some legal paragraph you can quote to them, I'm sure someone else will know this, I can't remember it. X

I doubt debt collectors will turn up angelrainbow, but if they do, you do not have to let them into the house. Just explain about the IVA and show them your chairmans report. That should get rid of them.

Try asking to speak to a supervisor next time you have a call, and get them to look you up on the Insolvency Register while you are on the phone.

Ignore the threats as they can do nothing to you at all - you are legally protected.

Can I suggest that you change your phone number? You can always tell your mum you are getting nuisance calls and have changed. You can change your mobile number as well -the first time I did mine, O2 did it for free. That way the calls should stop.

Freelili has put a post somewhere on here (I am sure someone will know where it is), about what to say to creditors on the phone.

It WILL get better!

Viki, that's what I have been trying to find - some legal paragraph to quote, I knew there must be one, but I didn't know where to start looking.

Hi angel

I must admit I got hassle for 2-3 weeks after my iva was approved but not 2 months - it must be very soul destroying and stressing you both out as when your iva is approved you don't expect this kind of hassle.

Maybe you could suggest when the UK ones ring that you can fax them your chairmans report or suggest they look you up on the insolvency register?

With the indian call centres it maybe a bit difficult to do this.

Yes, read Lily's post, that is the best one. I think I was thinking of section 40, administration of justice act 1970, which had been mentioned. I'm not sure whether it's relevant though.

Hi Angelrainbow,

First of all, don't worry, you are protected by the terms of your IVA despite what any creditor says, tell them that you're in an IVA and hang up.

Secondly, get in touch with your I.P. first thing and tell them what is happening to you regarding phone calls etc.
It is what they are there for, to help you thru the term of your IVA, you don't need to fax or anything else to your creditors, your I.P. will deal with them for you now that you are in an IVA

About two months after my IVA was approved I started getting phone calls from the LTSB call center in India, they insisted that I paid something to them and didn't understand the term 'IVA', in the end I just put the phone down and contacted my I.P.
A short while later my I.P. got in touch with me with an apology from the manager of LTSB and a couple of days later I got a handwritten apology as well[:0]

Looks like the LSTB still haven't changed their communications from when my IVA was approved over a yr ago.

Don't worry, you are protected, just tell them to go away

Hi Endsmeet, that's part of the trouble - the communication barrier. They simply don't understand me. Goes to show how little Lloyds think of their insolvent customers doesn't it.

Oh angel thats terrible.
I have to say with our iva I didnt get a single thing from lloyds, and they didnt even vote on the iva. I would tell your Ip and if nothing then I would ring their customer services again and again until I get someone who understands and deals with it.
Hope it sorts soon. Even though you know you are protected by the iva it must be stressful and it is so unecessary.

Ang, the trouble with the UK phone number is that they seem to go by account numbers and well, I don't have one as I was instructed to close my account as it had an overdraft facility and they were a creditor.So when I ring they can't 'find' me.
I will ring the IP AGAIN.
Tempted to report Lloyds for this stress and harassment..what do others think??

It is ridiculous isnt it. I would also be tempted to report them if I received anymore calls or I would go into a bank directly and ask to speak to someone and get their assurance that it will be dealt with and stopped.
