I have had a letter asking for money from 2005 for overpayment on an insurance policy paid to me. The company made a mistake and overpaid me by £592. The letter states I need to repay this in 14 days. I am curently in debt and don't have this type of spare cash. Can they demand this £ even though it is thier mistake and its so long ago? Can I refuse to pay or will they take me to court? Also is is reasonable to offer to pay a small amount each month? Please help and advise?

Hi Jane,

I'm really not sure what the position is with overpayments of insurance.

I hope one of the professionals can come along and assist you.

This is a debt just like any other debt and therefore as it was incurred within the last six years is still enforceable.

I am sure that the insurance company would be amenable to an offer of settlement, but how much is the extent of your other debts and are you managing to meet the repayments to these as well? How much do you owe in total?
