Hi guys
Just a quick question, my Iva was approved on the 27th March 09, Barclaycard never bothered to vote and have now passed the debt over to Mercers. I have been forwarding all letters from them to my IP however today i recieved a letter saying they were going to send a debt collector round. I am going to send this one to my ip also but i am slightly worried incase this does actually happen. All the other phone calls have stopped from everyone else, it just makes me cross that they think they are differant to everyone else and can still hassle everyone. I mean are they just being blantantly ignorant!!!!

SECTION 40 OF THE ADMINISTRATION OF JUSTICE ACT

“S40 Punishment for unlawful harassment of debtors.
A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract he-
harasses the other with demands for payment which, in respect of their frequency, or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation;
falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
falsely represents himself to be authorised in some official capacity to claim or enforce payment; or
utters a document falsely represented by him to have some official character, or purporting to have some official character which he know it has not.
A person may be guilty of an offence by virtue of sub-section (1) (a) above if he concerts with others in the taking of such actions as is described in that paragraph, notwithstanding that his own course of conduct does not by itself amount to harassment.”
Approved 3rd June 2009 first payment made on the day.

Mercers do not receive good press on this forum and mostly for the reasons that you have listed above.
I doubt very much that anyone will come round, it is normally a bluff tactic. If they do just tell them to go away, you are now legally protected from any creditor action by your IVA.

Hi,
We had the same problem with B/Card/Mercers, I did phone Mercers and gave them the info that our IVA had been approved, they actually thanked us and said they would correct there files, we never heard another thing from them after that.

I had enough letters from Mercers threatening debt collectors to paper the lounge.

It is unusual for anyone to call, but on the rare occasions that they do, the collectors are usually very polite and will go away having made a note of your IVA.

You have nothing to worry about.

the guys are right.ive only recently realised mself after getting loads of hassle from this firm is that they are trying to use scare tactics

hold your head high-they cannot touch you and like the guys have said these companies normally make these threats but rarely go through with them as it costs them lots of money

Mercers do do home visits, I had one the night before my creditors meeting. We also had one for the previous owner of my house too (Black Horse Finance).

I wish to tell all newbie posters that these visits are not as scary as you think, the guy looked like Norris off Corrie! Not Mike Tyson!

He was very polite, made a few notes and left. He could have been a Betterware collector for all my neighbours knew.

Please don't be intimidated with these threats over the phone. I just told Mercers to bring it on. [:D][:D][:D]
