Interim order - how long to process?

I've fallen behind with HMRC and although they've alsways accepted payments in the past and my payments have been made, they are simply not making any further arrangements.
They're demanding for all of my past vat bills (including those that I had arrangements for) to be paid now - £15k.
I have been issued a distraint order. Yesterday a field officer came and made a walking possessions order.
for a week and a half i've been speaking to an IVA consultant. They said they will do their best to get an interim order by next friday (5 days from the walking possessions order when they have legal right to remove my assets) but what is the likelihood of getting this done in 5 days?

Tell them you have a landlord who has put a distraining order on all your goods and they will keep away, parasites.

They are actually quite vigilant and send the bailiff the week after, so, just blag it and say non of the goods are yours don't let them do an inventory in fact don't let them in, then they can't do anything.

all the staff at the mo are mostly temps and havn't a b***** clue, I have first hand experience with these tos,,,,,rs every day on their cock ups, they are in a mess a big mess

Will that work after hmrc have already put on a walking possessions order? What do I do if they ask for proof?

The agent said it's out of his hands now and that an auction house would be contacting me to collect the goods.

My business is a cafe open to the public. I don't want a scene in front of customers - any idea how long it takes to get an interim order? The hmrc field agent said that's the only thing that would be able to stop the proceedings.

Tell them the owner is not there and neither is the person who deals with the tax aspect, and you are just a worker, they will not do anything then, ( they only deal with owners and people who pay the bills and Tax) also tell them the landlord has a distraining order on all the goods and non of them are yours ( even if they are) they don't know who the landlord is even if you own it. Even if it is the same person they don't remember so if they know you own it they are thick as s....t just tell them the person resposible is not there.

PS, They are still doing payment plans, so maybe phone them again and make a payment on account every week even if it is nowhere near what you should be paying. Or maybe just do a payment on account then at least their figures are up the swaney and incorrect so any judgment would be able to be challenged

I'm so stressed out over this - i feel like I really don't have a clue where i stand.

The people who collect the goods usually phone so you just say there is a distraining order on all the goods by the landlord, and he can't be contacted for whatever reason, ( my boss was in Spain at the time) so any reason will do annd you do not have a number for the landlord as you are just a worker.

I have been considering just closing the shop during the day. We have some private parties booked in the evenings but if these things will work...
I don't know... do these collections people only work 9 to 5 hours or do they come at all times of the day/night?

Best of luck, hope it all goes ok, 99% of companies going under these days are taken by HMRC and the government is supposed to be helping, a bit like Northern Rock who insist on 6 years in an IVA all backstage work by the government, they approved the IVA as a softener to people in debt but own more or less NR and insist on 6 years as do HMRC, back door or what.

Don't think they come at night, but not sure, just have to stick to the landlord is out of the area, and he has a distraining order lark. Yes I have unfortunetly been in that position twice in last 2 years and the only person there, but also remember that if any of it is corporation tax they cant do anything so don't let them threaten you.

I think they're just a local firm here in Leicester, called Smith Cooper. A friend went through bankruptcy last year and referred me to a solicitor that helped him, who put me in touch with John Harlow from Smith Cooper.

Maybe look at some of the IP's on here as they seem to work with you rather than against you and would soon have all that in check.
