Hi guys,

Nearly 18mths into my IVA. Cant lie its been tough, but a necessary evil and lessons being learnt.

Quick question. Checked credit reports, and few defaults are way off approval date, and one account is permanently on late payment status which i assume means would remain indefinitely on file until fixed.

I contacted the data controllers at relevant institutions requesting update of my credit files, also including copy of chairmans report. Main protagonist advised me in july via email they accepted info provided but it could take up to 28 days for them to update credit agencies. Checked this week after latest credit file update, no amendment as yet. Obviously a few weeks after iva approval date for default i can accept, but 1 is 8 months, and the worst hasnt even defaulted grrrr.

Is it financial ombudsman or Information Commissioner for next step to request that my files are amended with correct info?

Thanks in advance

John

It's the ICO you need to speak to -- but, 18 months in, you still have a few years to act. Have a quick read here: https://www.iva.co.uk/what-does-an-iva- ... dit-record

You need to get that late payment status account to register as defaulted otherwise it will never drop off !
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Yeah to be honest its that one that is really bothering me. Especially as they had accepted info i gave and said they would correct things.
Very Frustrating.

It is frustrating I know but something you have plenty of time to get corrected as, whilst you are in the IVA, it is somewhat irrelevant. Write to the ICO at the various institutions (the individual details can be obtained here https://ico.org.uk/about-the-ico/what-w ... ee-payers/).

Best of luck.
