yearly review, any advice would be helpful

HI
WE HAVE JUST HAD OUR FIRST YEARLY REVIEW, AND BEEN ASKED TO PAY £686.10 DUE TO PAY INCREASES BOTH ME AND PARTNER RECEIVED IN THE YEAR. MY PARTNER WORKS PERMANENT NIGHT SHIFT AND HIS WAGE SLIP SHOWS A SHIFT PREMIUM. AT THE TIME OUR IVA COMMENCED HIS BASIS SALARY AND HIS SHIFT PREMIUM WERE ADDED TOGETHER, NOW THEY ARE SAYING THAT HIS SHIFT PREMIUM IS ADDITIONAL INCOME, IS THIS RIGHT?. OUR EXPENDITURE HAS ALSO INCREASE, DUE TO NORMAL COST OF LIVING,AND AN ADDITIONAL £150.00 A MTH NEEDED FOR TRAVEL COSTS TO WORK BUT NONE OF THIS HAS BEEN TAKEN INTO ACCOUNT.

Hi there and welcome to the forum. I will try to give an opinion. I would have thought regardless of how it is described on his wage slips if the net amount has not increased they cannot justify it as a rise. I receive night allowance and it was assessed as my income but certain weeks I may receive less if on annual leave, at review they just take what I earned against what I am allowed to earn for the year, anything over I pay at 50% but that will depend on your proposal. If you have increaes did you send proof in the form of receipts. If so I would ask to speak directly to your IP to clarify the situation.

Hi
Is your IP asking you to pay £686 from extra income earned last year ?
What was the income that you declared on your original proposal and what is your average net pay now ?
Finally have you filled out a new income and expenditure form showing your increased expenditure ?

Hi, thanks for replying. we completed a new I&E form, which showed our expenditure had increased, and i thought this would have been offset against any pay increase we received, but they are saying that this will not be taken into account until the next review,in november. i'm just really confused, and maybe didn't ask the correct questions when our IVA started. but if you don't know what to ask, your stuck.

You should only be required to pay over more money if you can afford to. If the shift allowance was included as part of your husband's salary, then this must also be taken into account in the annual review process.

I would suggest that you discuss this directly with your IP rather than his/her staff as I am sure it has arisen as a result of a misunderstanding of your wageslips.

You are probably correct, we need to speak with our IP, as we have had numerous telephone conversations, and we cannot seem to get them to understand that they shouldn't count his shift allowance as additional income as it was included in his net salary lasy year. I wrote to them to try to explain my query, but they just insist we pay it. They have allowed us to pay over 12 months as we simply do not have a spare £686, this was negotiated from 6 months. But a further £57.00 on top of the £566 we already pay is going to be hard to find. A very tight year coming up. I am so glad i found this site, you tend to think you are on your own, and an IVA is not a subject I wish to discuss with friends so nice to be able to discuss matters.

I agree with Mel that you need to discuss it directly with your IP.
Makes you wonder just how many people are paying more than they should or have been denied a chance of a full and final because of wrong information from staff workig for IPs
