How are we coping? not very well ?

Heading says it all not coping with this situation very well, my husband does not talk about anything, he is absolutly terrified of the IP, he wont phone and speak to the person because he says he gets a telling off (putting politely), we also have tried commuicating via e-mails but get no response either, we have had our ups and downs with getting this iva sorted through a full and final from the begining and it has now been 19mts and still nothing sorted. We are now getting to the point of saying WHY did we bother and should have just gone bankrupt. There is a lot of things going on within our lives at the moment, house up for sale/ court cases/ i lost my job so out of work at the moment / husband on contract working which means he works a week then off a week.

SORRY TO RANT ON BUT THIS IS GETTING ME DOWN.

Hi butterflies, you rant away, we all need a rant now and again.

Do you mean you have been trying for 19months to offer a full and final???

Full and Final was accepted at the first meeting, which was june 2007, now apparently as i beleive it the ip has 12mths to pay this offer, but still no paperwork (completion papers/certificate) has been received to say this has been done.

I would be badgering the IP now. Thats a long time to be waiting for a completion certificate.

Have you been intouch and asked when they will be sending it?

Hopefully an expert will advise, it seems a heck of a long time to me.

I'm assuming you made an offer of a F&F but have been making payments anyway? If so, how were you going to fund the F&F?

It does get you down at times and I think this time of year just emphasises everything.

Which firm are you with Butterflies? There may be good reasons why the case cannot be closed, such as ongoing agreement of creditor claims, but that does not mean that they should not respond to your e-mails.

We did a re-mortgage to get the money for a full and final settlement also the sale of our endownment policies, this money has been handed to the ip some 2mths after the meeting, we have tried and tried to contact the ip via e-mail (i even sent one every day for 2 weeks) but nothing, and as i said my husband nor i will speak to our ip over the phone as they are very be-littling and make us feel very small.

Thank you all for your response, i'd not rather divuldge the name of the company we are using at the moment, maybe IF and WHEN this gets sorted i may put my diary contents onto a blog! now that will make some good bedtime reading. Just needed to have a moan and groan.

I read this and couldnt believe how youre being treated. I dont blame you for having a rant, its shouldnt be that way.

How about, I dont think so?

Write to this company and point a few things out to them.

Ask them what right they have to belittle you and make you feel like naughty children. Manners cost nothing, being rude and abrupt isnt helpful.

Mention the fact that you actually trusted them with one of the most important decisions of your life and youre not going to be made to feel ashamed or scared for trying to address it.

They are paid to know the answers and you are paying them in fees to provide a service, again, mention you didnt expect to be judged or stone walled.

Of course there may be reasons why its taking so long to complete but surely you have a right for these reasons to be explained in a professional and polite manner.

Finally, make sure you feed back your experience with the company on www.iva.com. to avoid anyone else having to go through the same.

You also might want to mention that you do not think it okay for them to use peoples vunerablity about debt against them in this way.
