Anyone able to offer some advise?

Hi,

I'm new to this site and just about to enter into an IVA!!!

My story goes like this. Myself and my husband have accumalated £64k in unsecured debts mainly by the age old trick of consolidating our debts and ended up in more debt than what we were in the first place. We own a tiny flat which has decreased in value and now we are in negative equity and unable to sell it or live in it. It's being rented out, however the rent doesn't cover the mortgage so we are paying our rent and also contributing nearly £300 to keep it going.

Therefore we are now looking into an IVA. We were recommended to go to DFD and they have been OK so far, however we received the pack today and there is numerous errors, one being that I'm paying £10 per month for anti depresants, which I have never said and certainly not at that point yet. It just alarmed me that something like this can be added!!! So my trust in them has some what deminished and concerned about proceeding with them, but feel like we are now so far down the line with them. Shall we continue?

They have also told us that the flat would have to be repossessed otherwise we wont get accepted?????

If anyone can provide me with some unbiest advise I would be very grateful.

Thank you Quark, i'm definately considering Melanie as really want to make the right decision.

We just feel that we seem to have gone quite far down the line with DFD. Would you recommend re-considering our provider?

yes for sure go to melanie her ratings are super dfd are a large company and i have read nothing but bad feedback she does much work on this site.it is a big decision choosing the correct one you are not tied to anyone yet i havent heard or seen one bad comment made about melanie and her team but the decision is yours.

If you haven't signed anything then there shouldn't be a problem - it's worth making a few more calls.

Choosing an advisor is an important step in the process and it does you no harm to talk to a couple of IPs to compare the level and quality of advice - on all options and not just an IVA.

With regard to your property, your creditors will not be prepared to allow you to continue to make mortgage payments on a property where the rental income does not cover these. But this does not mean that the property has to be repossessed. With the agreement of the mortgage company, you could sell the property on a voluntary basis.

Thank you Melanie for getting in touch.

We are happy for our house to be handed back to NR as we don't want to live in it. We have been told as you have already mentioned that the creditors would not let us keep the property on anyway.

What most concerns me that the creditors wont get paid once we enter the IVA. I have read on this forum tonight that this happened with someone else with dfd and i'm very worried. As this has happened to me before with a dmp, ultimately it got me into a worse situation, this is something I'm not willing to go through again.

What do you think about dfd being rather creative with my outgoings? "depression tablets?"

If you are not happy with this provider now - you ought to think twice about whether you want to spend the next five years in an IVA under their supervision. I suspect that the reference to "depression tablets" is simply an error, but one that should not have been made.

Have you actually had any direct contact with the IP yet - indeed do you know who is going to represent you at that firm?

I think you are right Melanie, it is a big decision and if mistakes are being made already then what is to come? The creative mistake wasn't the only one, errors have occured in a variety of places of which I have provided them with documented evidence which all they needed to do was copy.

I have not had any contact with the IP and have only known about this tonight as it's not been discussed at all. I only know her name due to it being on the document that we recieved today. I got the impression that dfd don't allow you to speak with them directly.

The more I speak the more I'm worried about dfd!!!

Sounds like an awful time you are having - I must confess it doesn't sound good that u cant speak to anyone. All contact I had with my IP was brilliant, he was always at the end of the phone and always very willing to answer any questions and explain paperwork.

Can you change who you deal with for your IVA?

LIKE OTHERS HAVE SAID MAKE SURE YOU HAVE COMPLETE FAITH IN YOUR IP AS TO BE WITH A IP FOR A CONSIDERABLE AMOUT OF TRIME IF YOU ARE NOT CONFIDENT IN CAN BE DISASTEROUS!
