Well after months of sleepless nights and 35 days of none stop work and overtime to save up the court fees my court date finally came and went.

I didnt sleep a wink last night and was sat on the edge of the bed from 4am this morning re-thinking what i could do to avoid going to court and declareing myself br, but nothing sprung to mind (well nothing legal and besides i dont own a shotgun) by 9 am when i arrived at the courts.

I was met by a rent a cop checking everyone and there bags going in on the side where he was stood he had a list of the cases and i saw my name at the top of the form and i said quietly thats me, he shouts out my name and says bankruptcy that way, i felt like fleeing and wacking him one as i turned to see everyone stare at me you would of thought he had said murderer the looks i got so i thought well this is turning out just nice.

I got shown to a quiet area by some desks and a very nice polite lady comes over takes my forms checks them, as me swear on the bible that its me and all the info in themis true she takes my 495 cash and says have a seat.
40 mins later she shows me to the outside of the magistrates and says the judge might see you he might not. 5 mins later she takes me back upto the quiet room asks how i am doing says the judge is fine with all the info gives me a reciept for the cash and a copy of my petition 1hr later she says the or office is having trouble with there fax machines and says an o.r will call you after 2pm you can go i say sorry is that really it she says yes the o.r will be in touch.

2.33pm telephone call from the or office asks some questions about my accounts and vehicle and says someone will call you next week on the 13th at 9am ?

Already i feel like a huge weight as been lifted off my shoulders and i can not believe that is it, i thought i would have to go in front of a judge explain my sorry state of affairs and explain myself about i got to this point but no i am now bankrupt and if the telephone interview goes ok then that is it until i get discharged.

I nearly took my own life for this stupid debt, i have felt the worse i have ever felt and i cant even begin to describe the shame i felt about myself and all done and lifted off my shoulders in 2hrs 50mins

Things really are never as bad as they seem.

I can say i feel positive im looking for new work i have a new understanding bank that are pro-active in not letting you get into debt, i really do feel like i have a fresh start and the light seems to be on at the end of the tunnel luckily for me i have no assets and br was the only option for me and im glad i did it before the creditors did.

Well done. I know what you mean about the weight that is lifted, I felt the same when I filed br. Your nearly there now, just the OR to deal with now.

Ours went fine, hubby had his seperate and just agreed with everything the OR said....his usual self! I questioned things and asked for more allowances than we had on the form(which we got). At the end of the day they are only doing their job and they are there to try to come to some arrangement IF you are able to pay something to the creditors. Remember to be realistic....3 years is a long time to be paying into an IPA/IPO if you are struggling.

Withoutapaddle - i agree as to a very good post - not something you wanted to do, but I'm sure like you say you can feel the weight lifted from your shoulders.

I'm glad it went ok and you're feeling better. I found the interview with the OR wasn't as bad as I was expecting - she was polite and to the point and explained exactly what the interview was for and what she needed to know.

skippy just been re-reading your blog and erm ooopppss i burnt all my statments when i decided i was definatley going to go br ****.(it was kind of like a statment i was making with my statments)

and also with the I&E do you think they will take in to account im still homeless (living in friends box room) and now saving for a deposit for somewhere to live im a little well more a lot worried that because i now have extra cash they will just take it off me and i wont be able to get back on my feet and once i am paying rent tax water etc will it change again

ok weight slowly coming back on my shoulders.

Well done Withoutapaddle. You've done the worst bit now.

I know what you mean about nearly taking your own life - that is how I felt about it all before I started down the IVA route.

At the end of the day it is only money and these companies all have contingencies and back ups and insurance to cover their losses. We aren't the first to get into debt trouble and we won't be the last.

Good luck for the 13th and let us know how it goes.

We didn't have any statements and the OR didn't even ask. We shredded them when we moved....should have kept them, I could have wallpapered the house with them!lol.
The only thing we had was recent demands so we just forwarded them onto her.

I didn't have all of my statements and the OR didn't say anything. I presume that if she needed them she got them direct from the creditors.

Regarding rent a cop - I got Adolph Hitler's long lost grandson when I went to court!
