Personal Injury Compensation, count as Windfall?

SO even though the monies is to be used to have surgery's which I need and the possiblilty that I could be out of work on the open labour market, they can legally take this money? so my surgery would not get done, which would impose even more on my life and career, as i would never be able to gain the monies again to get these surgerys done. would it not be in their best interest to let me use this money as a F+F as i could possibly be out of work for a longtime if this surgery is not complete, hence having no income.

also why is that all IVA IP's do not have to have a set standard for terms and conditions, as in this forum I have found different answers to different people regarding personal injury compensation.

It is not a case of what all IPs feel about this, but what your particular one does. The sooner you get their views the better, because if you are going to challenge their decision you may need to get your warpaint on.
