Even though he's never paid a penny towards the mortgage, I think that's disgusting.

All the bills are in my name and always have been.

Sorry to hijack this thread but it kind of answers a question I had ...

I'm now assuming that if I, as someone who is currently in an IVA, moves in with someone who owns their own house (I currently rent) then they will at some point become liable to my creditors staking a claim on their equity in their own property. Is there a way around this other than either not moving in with someone or them selling up (or renting out) their property to move into rented accommodation with me?

It does seem a bit harsh that a third-party can be dragged into this although I do understand the logic because it applies to couples who separate where one of them owns the house in their sole name.

But you say that he pays for the shopping - so how would you manage without his contribution?

To Wolf - if you are already in an IVA when you move into the property, the development of a beneficial interest is unlikely. And creditors would not be able to attack your partner's property at all.

I can pay for everything, he just feels he needs to contribute to something.

I am now told that as I have all bills etc in my own name and have done for all the years I've had my mortgage and my partner has no bills in his name at all and never has done, any Trustee would have to prove that my partner has a beneficial right to half of the home.

Phew ... i hope ...

you say your partner has now been signed off work indefinitely due to ill health so why will he be using his motorbike for work if he is on the sick? Is he claiming incapacity benefit and working[?][:(!][:(!][:(!]

He's not working at all at the moment, he's been signed off indefinitely but he has been told by CMHT that he can work for no more than 16 hours and let them know. Is this not right? [?]
