Welcome headoverheels - you'll pick up loads of advice to help your partner through the IVA on here. I'm not "officially" in an IVA as its all in my hubby's name but I still join in the forum.

Thanks julie. Yeah the IVA is all in his name too. I joined here because he is going through a bit of a rough patch at the moment and he doesn't know what to do so I thought I would see if I could find some answers for him x

Thank you everyone you have all made me feel so welcome already. My partner is a few months into an IVA and he recently got a letter from a company he had a compensation claim he put in about 2 years ago. He thought the claim had been dropped and thats why he never mentioned it to the IVA company. Now he has found out he may get something but he thinks it might be classed as a windfall and will have to give it over to the IVA. Sorry for the long post but thats the short version.

There was a post on here last night about something similar. I'm sure one of us or the experts will be able to give some answers.

Was it a personal injury claim? I believe it makes a diffence.

Yeah it was. He suffered some quite bad injuries and still suffers now with some of them. He just feels that he has to hand over the money. Yeah i read that post just seemed a bit confusing on some it as I'm not in an IVA I dont understand some of the technical stuff x

If it was compensation for injuries sustained then it may be protected Headoverheels ... he really needs to be upfront about it and contact his IP. Hopefully Ian Millington will read this and give more expert advice. Don't worry too much it will all get sorted.

I'm not too sure he was going throught the IVA before we started dating and he doesn't like to burden me with all of it so he keeps a lot of it to himself. But I just want to help. x

Sorry Headoverheels, I missed your question. You said that you have read the one last night regarding this. I think Melanie and Ian have pretty much summed it up. If it was for personal injury then most likely he may get, if for loss of earnings, then it would probably have to be handed over. It reall depends on how the windfall clause in his IVA has been worded so he really does have to approach them. He may be pleasantly surprised. I am not a technical expert so please hang in there for Melanie or Ian to comment, although you may want to start your own thread so the IPs can see it. Sorry if I've not been much help. X
