I have seen it in the past where the annulment has been granted but where the Court leaves it open for the debtor to ask for a review of the fees, hence it doesn't delay things, although the never ending spiral of costs (for what purpose I don't know)certainly will.

I entirely agree with Melanie. The very relationship between a bankrupt and the trustee has massive scope for conflict and the moment they knew who your trustee was they really ought to have told you they could not act. Based upon what you say the Trustees attitude leaves something to be desired too.

You now have a dilemma - do you simply roll over and pay up, if possible leaving your avenues for challenge open, or do you stand and fight, in the sure knowledge that the trustee will then claim further fees costs and interest and merely serve to increase your bill. Frankly I can't advise you because I don't know enough about the circumstances. What is certain that without proper advice from a lawyer who is actually batting for you I see only tears. Most decent insolvency lawyers will have a meeting with you off the clock whilst they look into whether they can help. Where do you live?

hi melanie... thanks alot for the messages n advice... it was none stop yesterday... n was late in getton sorted. thank god... someone on the other side... noticed... THE WAY IVE BEEN TRETE... even though i wont get to speak to you tonight... as its really late!!! n you probablys in ya second sleep... i carnt wait till tomora... to speak to u... ive had a lot to do last few days... i havent been able to get on the forum... im in the house all day tomora... iv got financial advicers comin. so will be on forum every minute i have spare... BY THE WAY... you asked where i lived... i live in SUNDERLAND... i tried all over to get insolvancy lawayer. the solisiter acting (for me)!!! £££... his office is in NEWCSTLE... thanks again IAN... lil shaza.

hello... i really dont dare dispute or query any price they are charging... IM JUST DOING AS THEY SAY... as i have said... they have a possession order on my family home... I CARNT EAT , SLEEP , OR DO ANYTHING I SHOULD BE... i just feel absalutley drained... MY HEADS IN BITS... i just dont no wot to do next!!! or who else i can turn to... on reading other members of the forum!!! HOW DO YOU EVER BE NORMAL AGAIN??? N GET OVER THIS??? cos at the minute... i carnt see a way out of this mess... ???

You really do need someone to hold your hand through all this and ascertain on your behalf what is going on.

One person who may be able to help you (if only to chat through things properly with you and your Trustee) is Gill Hankey of the Bankruptcy Advisory Service in Knaresborough. You could give her a try on 01423 799141. I am aware that she is not in the office until tomorrow though.

hello... dont no if its just me... paranoyer setting right in... ??? £££ ... N THE LAW IS THE LAW... but i really do think ive been badley done to. n trete wrong... from the the start. to where it is now... I FEEL LIKE THEY ALL IT IN TOGETHER. the inland revenue. the trustee. the trustees solistor. my solistor. n all the financal advisers theyve recommended... ??? £££... n the day of the hearing... IN THE COURT. WELL IV NEVER EVER FELT THE WAY I DID... WHEN THE POSSESSION ORDER WAS GRANTED... the judge made me feel so small. hiz attitude towards me. n the athourity in hiz voice... was so awful... i was trembling with fear...
HE WOULDNT EVEN LET ME SPEAK. WHEN I THINK NOW... IM ALMOST SURTAIN... HED ALREADY MADE HIZ MIND UP... ON GRANTING THE ORDER. THE TRUSTEES SOLISTER N HIM IN FULL CONVERSATION, LAUGHING N CHATTING ON... OUTSIDE THE COURT ROOM. AS I ENTERED. TOLD. THE BARASTER MY NAME. I WAS TOLD TO WAIT IN THE CORRIDOOR. HE CLOSED THE DOOR. WHEN I LOOKED THROUGH. SOLISTOR N JUDGE FLICKING THROUGH MY FILE. THEN IN THE COURT ROOM... BET IT LASTED NO MORE THAN 6 MINUTES... N THATS MY DECISSION. HE SAID. N EVERY TIME I TRIED TO SPEAK. I WAS TOLD TO SHUT UP... NOT EVEN 2 WORDS WAS I ALLOWED TO SAY... NEVER MIND VOICE MY OPINION. HE EVEN SAID. AT ONE POINT. IF I DIDNT SHUT UP. HE WOULD PUT ME OUT... HE WASNT INTERESTED OR BOTHERED ON WOT I HAD TO SAY... ??? THE POWER N AUTHORITY THIS MAN HAD. N THE WAY HE WENT ON. WAS ABSALUTLEY HORRIBLE... IV NEVER EXPERIENCED ANYTHING LIKE THAT DAY... She is there solely to help and advise you. She won't speak to your Trustee unless you ask her to.

If I may say Sharon it is clear from your posts that you have found it frightening to communicate with your trustee which I suspect may be part of the problem. If you have found it difficult to talk to the trustee (which is not uncommon) and so elected not to, that may just have been seen as sticking your head in the sand or disregarding the proceedings. I am also mindful of the fact that so far as your property is concerned, the Trustee has 3 years to take some form of action otherwise the trustees interest reverts to you. So there are 2 reasons that might explain why the Trustee is taking such a hard line with you.

The person to whom I have referred you is bound to be known to the Trustee but will definitely be acting in your interests as her role is specifically to represent bankrupts. If nothing else, she should at least be able to give you an indication as to why this is all happening to you and whether there is any way you can limit the damage.

If you have already answered this I apologise but what is your equity situation Sharon?

That is great advice from Ian - I know Gill very well, in fact I was in London with her last Friday, and you will be in very safe hands. My Dad was from Sunderland, and I love the place, although have not been back for a while. I hear that Roker Park is now a housing estate!!! My Dad would turn over in his grave.

It's been houses for the last ten year nearly...... The new stadium is impressive, especially now we have the new aquatic centre, olympic size pool and attached gym.

Dad was a season ticket there for many years, but I hear that the Stadium of Light is fantastic. Can't believe it is 10 years old though!

Make sure you ring Gill tomorrow, she is a great lass and was actually at the Palace yesterday receiving a much deserved MBE from the Queen. And she is based not too far away from you.
