Wish I could help, but I'm sure Melanie could advise. Just make sure he doesn't play games - you're trying to get yourself straight for you and your kids, so the best advice I can give is don't do/sign anything until you've spoken to someone who really does know where you stand.

Hi there, Melanie is probably having a well deserved rest. Sorry only just picked up this thread, are you already in an IVA or are you comtemplating one? If you are not yet in one but this is the path you are taking, the loan, albeit paid off in May, will probably have to be included in your IVA calculations as they are still one of your creditors. Is the loan in both your names? Kazzy x

Sorry, just re-read, you did say the loan in joint names. You could probably do with advice from an IP about this as it is more complicated because you are separating. I am sure Melanie or another expert will be along fairly soon to assist you. Kazzy x

yes finishes in may he has 2 credit cards he said was willing to pay if i carry on with the loan payments
his cards are more than the loan and my name isnt on them although i have had a card to use

You will be jointly responsible for the loan if it is in joint names, although there shouldn't be a lot left on there now.

If the credit cards are his,they are totally down to him.

Do you have any other credit in your name?

If you only have two creditors (the loan and one credit card), then you can't do an iva.

I think you need at least 3 creditors and in excess of £15,000 before you can be considered for an iva.

I missed your last one before my last post!!!!!

Don't think it matters about you being an additional card holder. If it's in his name, then it is his debt.

You should be eligible for an IVA based on the number of creditors.

Your husband will still be eligible for his half of the loan regardless of whether you have an IVA or not.

but will they make him go in the IVA i wont be with him well as soon as i get somewhere to live

They cannot make your husband go in an IVA. You will just have to declare all your unsecure debts to an IP.

i think only about 1500 left on the loan so that surely would be halfed?
I have no secured debts only unsecured loans, cards and overdraft
