PLEASE CAN YOU ADVISE? I AM GOING TO COURT TOMORROW AT 10.30AM TO HAND IN MY PETITION FOR BC.

HAVE TO FILL ALL THESE 30PAGES. I AM A BIT CONFUSED BY SOME OF THE QUESTIONS. CAN YOU PLEASE TELL ME IF THERE IS A GUIDANCE BOOK I CAN DOWNLOAD AND PRINT OFF. IF SO WHAT IS THE WEB ADDRESS,

MY PROBLEM IS THAT MY WAGES GO INTO MY BANK TOMORROW. IS IT ADVISABLE TO DRAW MY MONEY OUT BEFORE GOING TO COURT AS I NEED MONEY FOR THE COMING WEEKS BILLS ETC. ALSO IS IT TRUE THAT THE ACCOUNT IS MUST SHOW A ZERO BALANCE BEFORE THE JUDGE WILL MAKE ME BANKRUPT? LOOKING FORWARD TO YOUR ADVISE

MANY THANKS NICK

Hi nick

Here's a link for you

www.insolvency.gov.uk/pdfs/forms/debtorsguidance.doc

Make sure your clear out your bank account(s) and pay bills in cash. I don't think the judge will have any problem with making you bankrupt with a few quid in the bank but the OR may sieze it and will freeze your account anyway.

-Best

Hi Nick

I just wanted to wish you the very best of luck for tomorrow, could you let us know how it goes? It may help others on the forum who are scared right now and waiting. Thank you

HI AND THAKYOU FOR YOUR REPLIES. WELL, I WENT TO COURT AT 10.30 AND MY BC WAS DONE BY 11 AM!! I DID NOT EVEN HAVE TO SEE THE JUDGE.
ALL I CAN SAY TO ANYONE FEELING WORRIED ABOUT GOING TO COURT IS THAT IT IS A PAINLESS PROCCESS AND EVERYONE AT THE COURT WERE VERY HELPFUL. I MAY NOT EVEN HAVE TO SEE THE OFFICIAL RECIEVER, THE INTERVIEW CAN BE DONE BY PHONE.
THE ONLY THING I WORRY ABOUT NOW IS IT GOING IN THE LOCAL PAPER.
I DREW ALL MY WAGES OUT OF THE BANK BEFORE I WENT TO COURT AND I WILL OPEN A NEW ACCOUNT TOMORROW.
IF I CAN HELP ANYONE PLEASE FEEL FREE TO GET IN TOUCH WITH ME THROUGH THE FORUM.
I FEEL THAT I CAN NOW GET ON WITH MY LIFE AND MY WIFE IS SO MUCH HAPPIER.
THE ONLY REGRET I HAVE IS PAYING £4000 INTO THE IVA WHICH I HAVE BEEN TOLD WILL BE TAKEN UP AS THIER "FEES"
GOOD LUCK EVERY ONE
NICK

Hi Nick, glad it went well. It was nice to read a positive comment about BR from someone who has done it. I am going to court in a couple of weeks, and I'm a bit nervous to say the least! I haven't paid as much as you into my IVA, but I wish I had gone BR at the start - I'd be over halfway to being discharged by now! Do you know when you are having your phone meeting with the OR?

Onwards and upwards!!!

Good luck with the BR, I really hope yours goes well and this has taken some of the fear away for you. Dont regret trying an IVA, you gave it your best and it will look good and count in your favour, also I may never have known you. Time flies and you will soon be discharged.

Love

Hi Lily, thanks for your kind words.

Thanks Nick - I am going to try the Co-op as I like the idea of having a debit card and also being able to have direct debits. Good luck with the OR, from what I've heard it's nothing to worry about. Mine should be pretty straight forward as my only asset is my car, and that's not worth that much!

Onwards and upwards!!!
