Hi Alby, I'm so sorry that you are having a stressful time with this again, however, I do think you are doing the right thing by not signing the report and clarifying the situation - I think one of my modifications is also to do with my son and possibly finding work - I'm waiting for our report at the moment, if it comes to us as yours has come I too will not be very happy and will ask for the wording to be changed.

You are not asking for anything which is unreasonable, and ought to ask to speak to your IP directly if this becomes a problem. A rewording of the modification would be the most sensible option, but as your IVA looks as if it has already been implemented it may be too late for this, so your own IPs confirmation in writing would be helpful so that you have something on record that you can see and that you are not therefore relying on a recorded message out of your control.

Thank you again for your support. I will wait to see what comes through the post if it still doesn't sound right then I will ask to speak personally to my IP. I hope something can be done because Mel you're right my IVA has been implemented and I've made my first payment. I just want this all sorted so I can look forward. X

Hi all, I've got the letter from DFD now but I still don't feel comfortable with it. What do you think? This letter is to give me more detailed explanation of the modification which states as follows :- A minimum of £150 to be contributed by the non-dependent for board and lodgings within a maximum of 3 months of the commencement of the arrangement.
The letter explains that this is to give creditors a max return. It says if my son were unsuccessful in finding employment then we would need to report to creditors explaining what efforts have been made and progress to date that has been made. The job market is difficult at this present time. It then goes on to tell me to keep applications made, job adverts or any other methods used in his search for work to prove he is proactive in trying to find work. The letter finishes by reiterating that I sign and return my chairmans report. Do you think this letter is enough to make me feel my IVA will be ok? If I can't gain evidence from my son what then? X

I do - however I would have made the point to creditors from the outset that this was a nonsense modification which should have been removed or amended prior to accpeptance. The wording indicates that your son WILL find work and WIll give you the money. This is a modification which is outside your control and therefore should not affect your performance under the IVA.

Personally, I think this sounds a little harsh, especially in todays job market when it is very difficult to find employment.

I'm sure Mel will be along to advise later, and I hope Declan can pick up on this one.

I have a non dependent daughter who will be finishing Uni soon - at no time has anything been mentioned about her contributing to the household income.

The point is Jan it is a nonsense modification. If it said the money would be payable once work had been sought - fair enough. But to set a timeline for someone to get work and then pay B&L is ridiculous - and the creditor should have been told this at the time. You cannot put forward modifications affecting other persons and then expect the debtor to perform under those terms.

I think it is really bad, and to ask for someone to provide details of all job applications etc., smacks a bit of Big Brother to me.

If Alby refused to accept this modification now and didn't sign the Chairmans Report, what would happen?

Just picking up on this and I appreciate that it is an unusual modification. I certainly do believe that it is virtually impossible to guarantee employment in a specified period of time especially given the current job market.

I will look investigate this internally to try and understand more about this.

Hi Everyone, I've not logged on for a while because my pc decided to die on me! It became unstable and I did a partial restore on it but now it can't install windows. I don't have any recovery discs for it and I can't afford to get it seen to. If anyone can help by giving me advise on what to do I'd be very grateful. My little girl and I started baking for the first time the other day as I thought it'd be fun and cakes and pastries would be cheaper to make than to buy. Well, my attempts were pineapple upside down cake = heavy cake that tasted nothing like I remembered. Pineapple tasted good but thats it. Sausage rolls = pastry heavy but not hard also very greasy underneath. Cornedbeef pasties = great because I used ready roll pastry (gave up after sausage rolls) lol! if anyone out there can help me make a successful pineapple upsidedown cake and pastry that melts in your mouth please do.
My situation regarding my original post is still current. I did recieve a letter but it didn't really help. I still haven't signed and returned the chairmans report but this doesn't appear to have made a difference. I guess I will wait until month 3 when they expected my payments to increase. My son is still struggling to find work and I don't expect this will change anytime soon so I'm trying to encourage him into college to improve his chances. Anyway it's good to be back hopefully I'll get my own pc sorted and log in more often. Hope you're all well.

hope it all gets sorted for you soon . my son was 13 when we went into iva , hes going to be 18 in acouple of weeks but he left home and joined the army . he comes home at weekends, dumps his washing , eats me out of house and home and i swear he must use 3 tanks of hot water for just one bath !!!! i lost the csa money his dad paid ( which wasnt much anyway ) when he was 16 and the family allowance as he joined army in the september after leaving school . my payments have gone up by £130 pm, over last 12 months !!! hope u get ur pc sorted soon and learn the art of baking !!! i make a mean banana cake , as for other cakes etc , i found it was actually cheaper to buy them, and less messy .... my youngest is 4 1/2 so u can imagine the mess !!!! hope you son finds something soon , for his sake not the iva's

Hi Alby nice to see you back, we've got a great IT chap at work - I'll ask him for his advice re your pc and report back to you tomorrow.

I'm sorry to hear that you are still having problems with your IVA, hopefully Declan will sort this modification for you - it does sound rather silly!

As for baking - don't know a good recipe of upside down cake, but have a mean brownie recipe if you want. x[:)]
