bankrupt company are saying I own this money

hi davo - i know who the cheque was made payable to it was a lady friend of his - i have made appointment to see a solicitor who has understanding iva but i think i could loose my house for someone else dept as it would seem i could be made bankrupt myself

Just as a matter of interest, how did you manage to persuade your own bank to give you £20,000 in cash, and how was this handed over to your friend? This is an awful lot of money, and these days banks will be quite suspicious of these types of transaction.

Don't worry too much about losing your house and going bankrupt yourself as a result of this yet, but a good idea to take legal advice.

i ordered the money was asked how i got this money in which my friend replied divorce seletlement they counted out the money i had a building soc cheque writen out to his lady friend and he went off with his money and cheque i went off thinking i'd helped a friend - how wrong was i

i think the hardest thing to get my head around was the solicitor was fully aware of the iva and yet he gave me the cheque with out any problem surly he is also acountable same as i am ?

Would anyone at the bank be able to back up your story? Did your friend go to the bank with you on the day the transaction occured?

yes he did come with me to the bank and we wnet into a room where they counted the money out but this was in a small branch of the woolwich which has now closed due to the murge with Barclays - in all its not looking good is it

Cindy... have you asked your bank for copies of cheques drawn from your account?

This would show all cheques that have been received and paid from your bank account.

Ask them for all the information they can give you. It'll be the start of backing up your side of events.

Sounds to me like the police might need to go after him...at the end of the day he knowingly defrauded his IVA creditors.

At least you can prove you havent got £45,000 of the money so thats a good start![8)]

If there was no IVA restriction on the sale of the property it is possible the solicitor didnt know he was in an IVA!

What a horrible situation to be put in. Seeking legal advise is definately the best way forward. I hope all goes well with the solicitor and that you manange to resolve this horrible mess.
