to go for an iva maybe you have to use your disposble income, i take it you are in receipt of benefits?
if you could tell us a bit more of your situation i am sure one of the technical experts will be able to help, do you have any assets?

i am scared too i cannot work as i have an illness and my doctor said that i will claim disability allowance but have not got that yet. i am getting dicorced from my husband and i have a flat from council but no moved in yet. i am staying with mom and dad, i have a baby of one and 4 year old. my hubsband is bying my part of the house adn when i phoned up thry siad i coud do iva but on hear it says no. i am confused and very scared and i messed up big time.

mandy don't be scared, we are here to help in any way we can and support you through whatever you decide to do.
firstly you say your hubby is buying your part of the house, will this raise any money for you?

the reason i asked if you had any assets, coz i don't know the full situation have you thought of Bankruptcy, its not as bad as you think.It will give you a fresh start with the little ones.

to go for an iva you have to work out your income and expenditure for the month and whats left over with out paying your unsecured debts is what you offer into the iva, at present a lot of creditors are wanting a high return in the £ and can be quite difficult, i know melanie has had clients that have been on benefits but it is a long period of time in the iva, 5 yrs that you have to cope on a very strict budget.

i am just trying to give a picture for you, please don't be afraid i know its a hard time especially with the divorce and all, keep posting and we will see what help we can give

Dont worry there will be solution to it. You say your husband is buying your half of the house, will you get much for it. You need to post more about how much debt you have,who did you phone about an iva, there is an iva that you can pay a full and final amount, maybe this was what they meant.Post more and every one will be along to advise.

my hubby is getting the kids in the week as i am going ot care in the day because of a thing that heppened. i am phoned debt free adn they will do iva but i will use what is my share i will have the children at weekends but my car has to go i do not drive anymore and cant get the cheldren in time. can i do an iva. ??? thank you much for your time and kindness

it is about 18,000 what i think my share is and i phoned debt free direct. i am going to work in a shop when i better but not a teacher that i did do. i will stay with mom and dad but they do not know about debts.

i want to pay back soon but i dont have enough and the debts are much more 27,000. sorry this is hard i know. thank you for your kidness very much

Firstly most of us have "messed" up on this forum,for some its due to factors beyond their control for others its simply overspending and for some its a mixture of both[as in my case],so you are in good company.
You are in a strong position to offer a full and final settlement to your creditors ,from your share of the house.This will enable you to have a fresh start debt free.

i agree with andy, if you are getting a share you maybe able to offer a full and final settlement iva, i am sure once melanie has read your post she will be able to advise further.

i can understand it all but its difficult for me to types as i had stroke
i can talk fine but can not quiite get whats in m y head on the paperr i thimk that i will do thiis diffiuclt full and final could uyou exp;ain that is?? i think it is one payment iva ??? and i pay what my share is in one???

i did mess up had credit cards and it is my debt, we were havingg troubless ans he was awsay a lot so before the thing happened to me it was going to end anyway. i just waant to put it all behind the past. get better and ahve my babies back. will they let me have money to move in my flat. i need help now but getting much beeter with my left side. i have not told mom and dad as they are looking affter me and havee done so much. it would be horrible as the debt is all mine and i was wrong about it. ii just am truing to get back. i am me inside really but not outside.

mandy you just take your time, we will understand what you have written, sorry about the stroke, you are on the road to recovery.
a full and final settlement is just that, the ip will negotiate the figure with your creditors and hope they will accept, the IP's fee will also be taken out of share offered, as long as they all accept thats it.

in regards to your flat, if you are going to be in receipt of benefits there may be a grant allowed for helping you move and decorate, i am not sure on that one.

believe me we all messed up here and thats why we are here, you have nothing to be ashamed of in regards to the c/cards we have all done it and there is thousands out there still doing it who just haven't realised how deep in debt they have got themselves into.

don't be afraid to tell your parents as some times you need a shoulder, i was terrified of telling mine and they have been absolutely fantastic, i went Bankrupt the other week and they have been a tower of strength, only you can decide if you want to tell them , but they may get concerned when your share of the money has gone and you are struggling settling in your new falt, please think about telling them.
i hope you can get something settled soon, you take care of yourself for your little ones

Hi Mandy

You have already received many messages of support from our regular forum posters, and I really feel for you at the moment. Things can only get better and they will!

So I will concentrate on some technical advice to you if I may with regard to your financial situation. If you are going to be left with £18,000 from the sale of your property, and have £27,000 in debts, then an IVA is a good method of making an offer of settlement to the creditors which I am sure will be acceptable. Just make sure that you have enough capital to restablish yourself and the children in your new flat.

I do a lot of these types of IVA and the creditors like them as they get repaid their money at a lot earlier stage, and from your perspective you can put this matter behind you once and for all. You have enough on your plate at the moment, so find a good, sympathetic insolvency practitioner to act for you who will quickly review your circumstnaces and give you definitive advice.

debt free offered me to do it for 16,000 and keep 2,000 for the new flat, this is enough for me to do it what i need. i cannot mive in yet as i am liveing with mom and dad, the baby and 4 year old cannot live on my own them yet. getting better quick. move in about 6 momths and get easier job. looking forward to that. phone calls blaaaaaaar horrible. husband is dealing with papers. not selling house, he is giving me my own share from his dad. i thank you so much, i wanted to know am doing everything right. just have trouble with words on paper now and want to do it right. am very scared about it and do want it behind the past. it is new yet have to wait for all things on paper to be done. how long would it take, phoning me, telling me shouting blaaaaaarr. when its all over, i can keep my new money from disability and job? just give them my share of the house his dads money, yes?
