Hello,

Can anyone tell me if an IPA/IPO can be made purely on NT tax code grounds??

Would this be up until the end of the Tax year??

Any help would be appreciated.

Yes they can be made on the basis of your zero tax code, but will only then last until the 5 April next year.

Hello Melanie,

I'll probably have an income payment order until April next year then.

Where can I find out about how to explain my BR on the forms (see below), and what are acceptable levels of expenditure to the OR?

My reasons for BR is that I simply couldnt afford my IVA (which was really unaffordable in the first place and also took into account my wife's income at the time to supplement my wages and resulting IVA proposal), this failed, second child, wife not working to look after children, secured charging order by NR who pusued my wife with no income, reduction in income, IVA variation not accepted. HAD ENOUGH!

All very complicated I know, I just had enough.

28th September wont come quick enough for me and my BR.

How far in advance do I have to book an appointment with the BR clerk?

Any help is very much appreciated.

You will need to contact your local county court to check that they actually deal with BR (mine didn't which was good as I used to work there!) and to find out whether you need an appointment or if they are first come first served. I would give them a call ASAP as I know some courts have very long waiting lists - Brighton was about 16 weeks earlier this year.

Reasons for bankruptcy - I used the same reasons that were stated in my IVA proposal.

Although the OR works to guidelines, a lot of the expenditure allowances seem to vary. I would say be honest and list what you really spend. Don't be extravagant, but don't leave yourself short. I have listed my allowances on my blog, but obviously they are different for everybody.

The staff in the Official Receiver's offices all have their own individual discretion as to what is and is not allowable. I think that this is a fair system, as it allows examiners to make their own mind up about what is reasonable - as most regular forum members know I detest benchmarked expenditure.
