Hi all,

I took out my IVA 7 years ago.
It was paid in full after the 5th year.
I was told I would still not get a completion certificate until the original expiery date of the IVA which would be another year (6th year)

Now at the end of the 7th year (1 year after the completion date) and 2 years after the full and final payment and I am still waiting [:(!]

I have accepted all new terms and conditions, (which seem to be every 4 months) I have accepted they check for PPI etc... but still I am waiting.

Legally can they keep me waiting this long?
I am seriously thinking of taking leagal action as I am now approaching 84 months.

I notice on there website everyones email address is available who work at GT, before I mass email everyone does anyone know what the current situation is with them?

Having just searched the Individual Insolvency Register
It appears My status is still current

"Individual Voluntary Arrangements will remain visible while they are Current, and for a period of 3 months after the receipt of notice of the revocation order, full implementation or termination of the agreement "

Hi

It is not good but you are in a long queue awaiting your completion certificate from GT.
Maybe Grant Thornton will update everyone on the forum ?

Look at my post and see if this path is the way forward for you. Do you know who your IP is as making a complaint using the link in my post requires it to be specific to the IP.

Waiting times do seem to vary quite significantly between different companies. Hopefully someone from GT will see your post ukmdb and get on the case for you asap.

It would be interesting to know what really can take so long as GT may be at the mercy of those they are trying to claim from and therefore out of their control.

Keep us posted.

I sympathise with you entirely, I am sick to my back teeth and like you am thinking of taking legal action against GT too. We settled early last august after two years of being mucked about with our IVA we paid early.
We have had nothing but problems with this closure and still a smidge under one year after settling early we are no closer to having our IVA closed.
How is this allowed to go on? even though who have served their 'sentence' for want of a better word.

I have complained to Paul Madden at GT and also to the IPA because I'm quite bluntly fed up of waiting for answers.

All I want is to move on with my life and until they give me the certificate we can't.

I sincerely hope that they sort this out soon because I will be seeking legal advice regardless of what anyone else advises.

Have you contacted Jo Swinson MP ? Apparently she has an interest in these things.

I just emailed her however in her automated response she can only help those in her own constituent, which I'm not.

End of tether.......!

Have a look here:
http://www.iva.co.uk/forum/topic.asp?TO ... jo,swinson

If you contact her as a Minister, not as a constituency MP, then she has to take notice.

Hi
Just reading the various posts and thought that I would update you with our situation.

We have just received an email from GT (finally!) and basically they said that we should be receiving documentation soon telling us how they intend to pursue the VAT issue.

This is despite the fact that the VAT issue was raised at a variation meeting last June and the resolutions accepted (then with Tenon).

This is also despite the fact that a Full and Final settlement variation meeting was arranged with GT in December last year which was also accepted (with PPI). The documentation that we have states that, from this meeting, it would take 6 months to close the account. The account being with their closures department.

They have informed us today that until the final dividend has been calculated and sent to creditors they cannot let us have our Closing Certificate.

What have they been doing the last 6 months???

As far as we were concerned we were just waiting for the Certificate.

81 months since the start of our IVA.
16 months since last payment.

So basically that is where GT are at the moment... with our file anyway!

Totally give up!
Katy

If your F&F documentation states 6 months and you have not had any notice of their intention to extend this, then the IVA is finished, as per contractual terms agreed. They have your agreement with regards to dealing with PPI post completion, so there should be no delay.

GT have always regarded the 6 months as a minimum, rather than the maximum period in which to close :-(
