My husband may be entitled to a pay rise from a deal from a few years ago from his works. If he is entitled to it will it be classed as a windfall or would he be able to keep it.It wont be much maybe a couple of hundred pounds.
Iva finished !

It will be treated as additional income and probably subject to the 50% uplift clause - depending upon the actual wording of his proposal of course.

Interesting to know because we are in a pay dispute at the moment and were told our pay increase will be back dated to July when it is finally settled so some back pay will be due.
We're willing to wipe the slate clean, give you a fresh start. All that we're asking in return is your cooperation.

I have the same thing, we should have got our annual pay increase in april, but they have not awarded us this yet, it will probably be coming in our sept pay and this will be backdated to april, my proposal says i get to keep 10% then its 50/50. gutted really as i am using my contingence and some of my food money already to cover my raise in rent :( my IP is aware but refused to do anything about it. i hope they dont increase my payments too after this rise as i was told i will get an extra £60ish each month, which will help so i only have to find £40 for rent then so it will be a lot better. I just hope they wont increase my payments, i really dont want this to fail so early as i am only 6 months in :)

I'm in the same boat. I work for the NHS and I am due 4 years back pay anytime soon, which I had planned to use to pay off a few of the smaller debts, but as I will only see half of it, this won't be possible anymore.

Are you already in an IVA Siorgha? If so, you should not be contemplating paying off any of the debts directly outside of your IVA.

No I am not in the IVA yet. I am still in the process of setting it up, which is why I was hoping my backpay would be in before I started.

How far into the process are you?

If all your creditor details are with an IP, you should not be paying anyone off. It is treating creditors unfairly and I would imagine could cause a problem.

I have made contact with my IP and hopefully should be finalising things tomorrow.

Thanks for the advice, I am new to all these rules and regulations.
