wanting to apply as School Governor

Hi

I already have an IVA, but I am wanting to apply as School Governor at my local primary school. However, two of the conditions of appointment on the application are:

1. You are not the subject of a bankruptcy restrictions order or an interim order or your estate has been sequestrated and the sequestration has not been discharged, annulled or reduced;

2. You are not subject to a disqualification order or disqualification undertaking under the Company Directors Disqualification Act 1986, a disqualification order under Part 2 of the Companies (Northern Ireland) Order 1989, a disqualification undertaking accepted under the Company Directors Disqualification (Northern Ireland) Order 2002, or to an order made under section 429 (2) of the Insolvency Act 1986;

Would either of these prevent me from being appointed (I remember having an interim order before the IVA was finalised, not sure if this would apply or even if it's still in force)?

Hi Martyn and welcome to the forum

Congratulations on wanting to take up a very worthwhile position.

Your Interim Order is discharged once your IVA is accepted, so as long as you have not been disqualified from acting as a director then I cannot see any problem in you taking up the post.

Seems strange the the provisions they are quoteing are a mixture of English and NI law. Are you based in Northern Ireland?

I am in an IVA and am a school governor to two schools, good luck with the application, it is a worthwhile cause and I love it!
