I was declared bankrupt in Feb. 2004 (a five year period) but 18 later received a cheque from the Official Receiver of £2,600 with a letter stating that all outstanding monies had been paid to creditors and the cheque enclosed was "the balance". After many futile attempts to the Court and Official Receiver, I am still uncertain if the Bankruptcy Order was discharged at that date or if I will still have to wait until February 2009 to be declared discharged. Could you please clarify the situation for me?

Hi sg and welcome to the forum

Why were you given a five year bankruptcy period? And you can check with the Insolvency Service's Insolvency Register to see whether you have actually been discharged.

As your case appears to be a surplus case, where creditors and costs have been repaid in full, you could always apply for an annulemnt of the proceedings, but this would cost in the region of £1,000 in legal and Court costs.
