Thank you Barclays are actually stating in the letter that if we have a CC they will be happy to send it to us we are just concerned what the consequences are if we take it.

That's goof if Barcalys are saying that.

That means they believe they no longer have a requirement to send to your IP and as it should bed your obligations to the IP are fulfilled.

Id be trying to get hold of that money before the appeal hearing next year. You could spend £100 or so getting a written legal opinion from a solicitor that confirms you have no legal obligation to give that money to anyone else, that covers your bases.

If you really wanted to you could write to your previous IP and ask them to confirm that if you were to receive a windfall now such as inheritance or PPI payments that you are not obliged to put it in the now closed IVA (though you are drawing attention to something there).

Or you could put it in the bank and not spend it until the next high court of appeal hearing in May gives its ruling, at which point you would know one way or the other.
