What happens to ppi refund payments while in an IVA

I give up - I rang my IVA company again today, was once again told the money was mine to keep as the case was closed, but that they could not confirm that in writing as they were no longer acting for me! So that's twice I have phoned them and been given the same answer. Plus the refund that was paid to them directly by Halifax, they have transferred that into my Bank Account. Am I safe to now assume that I can keep my PPI refunds?

If they won't confirm it in writing then you should put it in writing to them such as " further to my telephone conversation with your (insert name) on 12/09/12 I would confirm that you have advised etc etc"

Even if they do not reply to you, at least you have something to record what was discussed.
7 years after starting an IVA I finally received a completion certificate from ClearDebt

@heretoday - thanks for the advice - I will do that so, as you say, there is some record in writing of me having spoken to them.

As Heretoday suggests, write to them along those lines, send by recorded delivery.

State the contents of your discussion with them and ask for written confirmation. Follow this up by something like: " If I do not hear from you to the contrary within 28 days I will take this as confirmation that the IVA has no claim upon the monies, now or in the future."

You could probably word this better, but you are getting confirmation by default if they do not respond.

I posted recently my credit report says on a default as satisfied at 60 months with my IVA showing completed. The narrative read on the default. Partially settled, in full and final payment!

An update - rang again and tried to speak to my former IP, but as usual he was not available. I asked the nice girl i spoke to if she would please confirm with the IP that the PPI refunds were mine to keep. She rang back a few ddays later to say that as far as they were concerned the case was closed 3 years ago and that they were not no acting. i asked for confirmation in writing, but she said that as they were no longer acting, they could not provide this! So today i have sent my former IP a letter recorded delivery confirming exactly what was said and stating that any current or future PPI claims are mine to keep and not to be paid into the IVA. Not much more I can do now - still doesn't feel like the money is 100% mine yet though!
