what is my best plan of action?

hi everyone,my proposal is being put together and my ip has told me not to pay any of the creditors,i have paid him one payment of what he considers is my affordable amount,my problem now is i have all the creditors contacting me by letter/phone for a payment.i have advised them all in a pleasant manner that mu ip has all the information they require and is quite happy to talk to them,but most of the creditors say they will not deal with a third party until the propsal is submitted,what is my best plan of action?

Hiya Eeun

You are now going through what most people on here have gone through prior to IVA/Bankruptcy. You will get creditors bombarding you and they will try and scare you into paying. I would advise you to read Go4Broke IVA blog, it contains some brilliant advice on how to get creditors "where you want them". When they ring, just tell them to contact your IP, if they don't listen tell them again, if they don't listen still, repeat again and hang up. You will probably get loads of letters as well, just open them and send them to your IP.

If they contact you at work, make it clear you will not talk to them at work and make sure you read the various posts relating to harassment so you can quote the relevant regulations if necessary.

It won't be a pleasant period, but keep focusing on the fact that you are approaching the light at the end of the tunnel. If it all gets too much, change your phone no (ex directory) and only give that number out to family and friends, not to any business or company.

Your IP has provided good advice, and as the proposal is almost completed I would not worry about these calls. They really don't mean anything, but all you can do is tell them the truth about the current state of play.

Your IP should have written to the creditors on your behalf, so they can hardly say they are unaware of what is happening.

As already stated just be strong and keep saying NO.You are going through the stage that everyone seems to go through prior to an IVA.The people phoning you are just doing their job and you are just one of hundreds/thousands of people that they phone.

Hi Eeun and Welcome to the forum,

I agree with the advice given above, you have made a great decision to deal with your debt problem so don’t let the creditors phone calls/ letters get you down.

As Andy Davie stated the call made to you is one out of thousands that these people make. Unfortunately these calls may occur right up until your IVA is accepted.

However an IVA is legally binding on both sides, so they will end once it has been accepted and filtered through to the relevant departments.
